WHEREAS, the City Planning Commission did hold a public headng et the City Hell in the City of Anehdm
on January 4~ 1965~ at 2:00 o'clock P.M., notice of said public heariag having been duly given as required
by law and in eccoedence with the provisions of the Aneheim Muaicipel Code, Chapter 18.68,to hear end consider
evidence for and egeinat aeid proposed veriance end to investigete and meke findings end recommendetions in connec-
ttun therewlth; end
WHEREAS, seid Commisaion, efter due inspection, inveatigetion and study mede by itself end in its behelf,
aad efter due coneideretion of ell evidence and repods offered as eaid nearing, does find and detennlne the following
fects:
1, 'fhat the petitioner requests e variance from thr Maheim Municipel Code: Section 18 0 28 0 05 0(3) whiCh
requires that each one fami:~y dweiling shall be a minimum nf 1225 square feet per urrit; Section
1g;28,050(6-b-2) which requires that the minimum requ:red side yard be five feets Section
16028o050 j7-a) which requires ttiat th d'stance between two main buildings be the sum of the
two side yardsg and Section 18,28,050~(10~ which requires that 1~ covered parking spaces shall
be required for each unit +.o construat an additional detache dwelling of 87~4 aquare feEt
with a side yard of 4 feet9 distance between two main buildings of 9 feet, and 2 covered park-
ing spaces on subject propertya
2, Thet there ere exceptionel ot extreordtnary circumstences or conditions eppllceble to the propedy involved
or to the intended usa of the pmperty thet do not apply genecally to the property or claes of use in the same vicinity
end zone.
3, That the cequested variance is necessery for the preservation and enjaysacn; of s substantial property dght
poasessed by other pcoperty in the seme vicinity ead :one, and denied to the ptopeRy in question.
4, That the requested vadance will not be materially detrimentel to the public welfaee or iniurious to the pm~

NOW, THEREFORE, BE IT RESOLVED thet the Aneheim City Plenning Commission does hereby grant subject
Petltion for Vadance, upon the following rnnditions which ere hereby found to be e necessary prerequisite to the pro-
poaed use of the subject propecty in order to preserve the safety and generel welfere of the Citizens oE the City nf
Meheim.
lo That the owners of subject property shail pay to the City of Ma::°im the sum of 15~
per front foot along Chartres Street9 for tree planting purposes~
2o That the sidewalks and curbs shali.be removed and/or reconstructed along Chartres
Street9 as required by the City Engineer and in accordance with standar~9 plans and specificat-
ions ~n file zn the office of the City Engineere
3o That trash storage areas shail be provided in accordance xith a~proved plans on file
with the office or the Director o: Pubiic Works~
4o That the owners of subject property shail pay to the City of Maheim the sum of $25000
per dwelling unit9 to be used for pa•rk and recreation purposes, said amount to be paid at the
time the building permit is issuedo
5o That the owners of subject property sha11 pay to the City of M aheim the sum of $2~00
per frorrt foot along Chartres St•reet, for street lighting pnrposes~
• 6o That the owners of subject property shail deed to the City of Anaheim a strip of land
seven feet ~n width a:iong the southerly property line for a1Tey widening purposeso
7o That Condition Nos~ 19 59 and 69 above mentionedo shail be compl3ed with prior to the
time that t#~e Bvilding Permit is issved or wlthin a period of 180 days from date hereof, which-
ever occ:ars firsty or such further time as the Commission or City Counci'1 may granto
