That the pcoposed uee is properly one tor which a Coaditional Uae Peimit is authodsed by this Code, to wit: establish a market and service station within 75 feet of a residential zone, establish a walk-up restaurant, waiver of the height limitation within 150 feet of a single family residential zone, and waiver of the minimum required parking for the market and walk-up reataurant, on subject property. 2~ That the petitioners withdrew the request for the market and walk-up restaurant at the public hearing. 3. That the proposed use will adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 4. That the proposed use will establish a pattern of strip commercial development in an area presently developed for single family residential use. 5~ That the granting of the Conditional Use Permit will be detrimental to the peace, health, safety, and.general welfare of the Citizens of the City of Maheim. 6. That the siqnificance of North Street, now functioning as an arterial highway, will. be substantially altered when La Palma Avenue is extended westerly from East Street across the railroad right-of-way, particularly if the Public Utilities Commission requires the closing of North Street across the railroad right-of-way, thus making North Street a local street which will cul-de-sac three blocks westerly of the intersection of North and East Streets. 7. That two persons appeared representing 25 persons present fn the Council Chamber opposing subject petition.
