Z~0_ HE DENIEU WHEREAS, the Ciry Plaaning Commisaioa of the City of Aaaheim did receive a veriQed PettUon for Conditionel Use Penaitfrom FRANK K. KROGMAN, 2338 Wagner Avenue, Anaheim, California, ~arner, of cer4ain real property~situated in the City of Anaheim, County of Orange, State of California, descrtbed as the Westerly 350 feet of the Easterly 540.79 feet of the Northerly 3 acres of the East half of the North half of the Northeast quarter of the Southwest quarter of Section 13, in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a map thereof recorded in book 51, page 7, et seq., Miscellaneous Maps, records of said Orange County • ; aad WHEF.EAS, the Ciry Plenniag Commiasion did hold a public headag at the City Hall in the City of AneheIm on May 10~ 1965~ at 2:00 o'clock P.M., aotlce of said public headng having beeu duly given as required by lew and in eccordance with the provislons of the Maheim Munidpal Coda, CJiapter 18.64, to 6ear end a+nsider evIdence for end ageinst said proposed conditioaal uae and to investigete and make findings and recommendations in rnnnection themwith; ead WHEREP.S, said Commiasion, after due inspection, inveatlgation, and study mede by itself end in its behalf, and efter due voasideration of ell evidence and reports oEfered et seid hesdng, doea find end determine the following Ewxs: 1. That the proposed use is properly one for ahich a Conditioaal Use Permit is authodsed by this Code, to wit: estahlish a convalescent hospital with wa~ver of Se~tion 1R-50.070(3-al which req~~ires w 31 foot setbacJc t~ permit a 20-foot setback and Section 18.40.070(2-a and 5-a) which requires that screened planting shall be provided adjacent to a residential zoned boundary. 2e That.the proposed use will adversely affect the adjoining land uses and the growth a-3d devPlopment of the.area in which it is proposed to be located. 3~ That the granting of the Conditional Use Permit will be detrimental to the peace, health, safety9 and general welfare of the Citizens of the City of Anaheim. 4, That four persons appeared representing seventeen persons present in the Council Chamber and a petition signed by 414 property owners was p:esented opposing subject pPtition. ~ ~ ~ s il ! 4 / NOW, TIiEREFORE, BE IT RESOLVED thet the Anaheim City Planaiag Commiselon does heceby deay subJcct Petition fot Coedition~l Use Pecmit on the baais of the afocementloned flndings.
