I 1 WHEREAS, the Clty Plenning Commisaion of the Clty of Anehelm did receive a verifled Petltian for Candltlonal Uae Permit from JOSEPH ~~. CEWNKIN, 213 West F3a11 Road, Anah~im, California, Ownnr of certairi real property situated in the City of Anaheim, County of Orange, State of California, described r~s Lot No. 36 of Tract Na. 1909 ; end WI~EF.EAS, the Clty Plenning Commtssiun dld hold a public hearing at the Clty Hall in the City of Aneheim on November 8, 1965, et 2:00 o'clock P.M., notice of said public hearing heving been duly given es required by law end in eccordence with the provlsions of the Anc+helm Munlcipel Code, Chepter 18,64, to hear and conaider evidence for end against seid proposed condltionel use end to investigete and make findings and recommendations in connection therewith; and WHEREAS, seid Commi~aion, after due inspection, investigetion, and study made by itself and in its behelf, and after due conslderation of nll evidence and reports offered at sAid hearing, does find end det~rmine the following facts; 1. Thet the proposed use is properly one for which e Conditionnl Uae Permit is euthorized by this Code, to wit: establish a music instruction studio and minor instrument repairs in an existing residertial st.rur,ture with waiver ofs Section 1A,40.070(Q-a and 2-f) w}~ich requires that eight parking spaces be provided, four spaces are proposed; SecLion 1~o4U~07U (3-a) which requires that the height of any building within 150 feet of a single family residential zone boundary sl~al.l not exceed one-half the di.stance from said building to the zone boundary to permit a proposed addition i:o an existing structure to be located wiLhin five feet of the k~l Zone boundary to the north; Section 18.40„050(a) which reyuires that all parking shall be provided a± the rear of the residential structure, to permit parking on the side property; and Section 18~40.070 (5-a) and (4) which requiies a 6-foot masonry wall and landscaping on tt~e north and east property lines to separate and screen the commercial from the residential uses, and a land- sr,aped strip to screen the off-street parking which ab~~ts a local street. 2. That the proposed use will adversely aff'ect the adjoining land uses. 3~ That the size and shape of the site proposed for the use is inadequate to allow the full development of ihe proposed use in a manne.r not detrimental to the particular area nor to the peacey health, safetyy and general welfare of the Citizens of the area in which it is proposed to be located. 4~ That the proposed use would be incompatible with the residential integrity of the area in Nrhich it is proposed to be located„ 5~ That the proposed use, if approved would be grantinq tt~e petitioner a privilege not enjoyed by the adjacent properties. 6.
