That ihe proposed use is properly one for which a Conditlonel Use Permit is authorized by this Code, to wit: establish a drive in restaurant with waivers of: 5ection 1~i.04~03U(b-12) which would require 46 parking spaces For the propos~rJ cornmercial use, to permit development with 45 usable parkirig spaces; Section 1~+~40.070(2-a-3) whict~ requires a minimum 10 Foot landscaped setback to permit ~,o landscaping for a portion of the site; and Section 1~.40,070(?-a-4)which requires ~ G foot masonry wall to the reax of the 3 foot wide planting strip~~~hem 2~3rds of the property in the block opposite said propPrty (South Street) is developed for single family residential use. 2. That the piof;osed use would proiect considerable more commercial traffic onto a local street (South Street), than those permii;ted by deed restrictions placed on subject property. 3, Thai: the petitioner has not ~hown that a land use haic~ship exists in the development of subject property For the professional and medical uses approved for the property when rer.lassified to ~the C-1, Zone, and that the single family homes were in existence at the time the petitioner purcf~ased the property. 4. That the C-1 deed restricti~ns placed on subject property were for the protection of the single family home owners, in order that the permitted tises would be mor.e compatible with the residential inteyrity of the area. 5.
