A RESOLUTION OF Trill CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE SETTLEMENT OF
CERTAIN EMINENT Do~mIN LITIGATION (SANTA A1~A
RIVER CHANNEL) .
WHEREAS; heretofore, in an Eminent Domain action, the
County of Orange sought to condemn a portion of the Shorb Well
property owned by the City of Anaheim in the Santa Ana River
Channel, being Orange County Flood Control Project No. EOI, Parcel
&08. 2103, 2103.1; and
~~riEREAS, the County of Orange has offered to pay the sum
of $8,386.75 to the City of Anaheim in full settlement of said
litigation and in consideration of the City of Anaheim deeding the
property sought to be condemned to the County of Orange; and
WHEREAS, the City Council finds that it is in the best
interest of the City of Anaheim to settle said Eminent Domain
litigation by accepting the offer of the County of Orange and by
executing the necessary documents to accomplish the same.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the Mayor and the City Clerk be, and they
are hereby, authorized and directed to execute a Grant Deed, an
Easement Deed and a Right-of--Way Contract as the same had been
presented to the City of Anaheim and approved by the City Attorney.
BE IT FURTHER RESOLVED that said documents upon execution
be delivered to the Office of the City Attorney for transmittal to
the County of Orange.
IrHE FOREGOING RESOLUTION is approved and signed by me
this 2nd day of February: 1971.
