PC 66-13RESOLUTION N0. p'~' 66-13 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETi"ION FOR CONDITIONAL USE PERMIT ~64 gE GRANTED ~' ~. ~ d. ` ~ i ~ I : i ~," !~ WHEREAS, the City Planning Commission of the City of Maheim did receive a verified Petition for Conditional Use Permitfrom WALTER HEMPHILL, 951 DJorth Gilbert, Anaheim, California, Uwner ef certain real property situated in the City of Anaheim, County of Orange, State of California, describecl as The South 17R feet of the East 220 feet of the Northeast quarter of the Northeast quarter of the Ncrthwest quarter of Seciion 7, Township 4 South, Range 10 West, San Berna:dino Base and Meridian. EXCEPTING THEREFROM the East 130 feet of the South 63 feet ; and WHEREAS, the City Plenning Commission did hold e public hearing et the City Hell in the City oE Anaheim on July l~i~ 1966, at 2:00 o'clock P.M., notice of said public hearing heving been duly givm as required by law and in acrnrdance with the provisions of the Meheim Municipal code, Chapter 18.64, to heer end consider evidmce Eor and against said proposed cronditional use and to investigate and meke findinga und recommendetions in connection therewith; and WHEREAS, said Commission, efter due lnnpection, iavestigation, end study mede by itself end in its behelf, end aEter due consideretion of ell evidence and rcports offered at said hearing, does find and detertnine the following fects: 1. That the proposed use is properly one for which e Conditional .Use Pecmit is outhorized by Code: Section 13.64.020(1-b) - to establish a child day nursery on subject property. 2. That the proposed use will not edversely effect the edjoining land uses and the growth and development oE the area in which itis proposed to be located. 3. Thet the size and shape of the site proposed for the use is adequate to ellow the :ull development of the proposed use in e manner not detrimentel to the perticuler area nor to the peace, health, sefety, and general welfere o~ 'he Citizens of the City of Maheim. 4. That the granting of the Conditianel Use Permit under the conditions imposed, if eny, will not be detrimentel to thP peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 5. That the petitioner stipulated to operation of 5 days a week between the hours of 8 A.i4. and 6 P,M., and a maximum number of 30 cnildren. 6. That 2 persons appeared in opposition before the Commission, representing B persons present in the Council Chamber, one of whom presented a petition signed by 17 persons. Two letters were also received in opposition, and nne person appeared in favor of subject petition. Cl-G _1 ~ I ~ NOW, THEREFORE, BE IT RESOLVED that the Anaheim City plenning Commission does hereby grent subject Petition for Condi4ionel Use Permit, upon the following conditions which ere hereby tound to be a necessery prerequisite to the proposed use oI the subject property in ordet to pteserve the sefety and generel welfare of the Citizens of t6e City ot Anaheim: 1. That the curbs and gutters shall be repaired along Rain6ow Avenue, as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineera 2o That trash storage areas s}tall be provided in accordance with approved plans on file with the office of the Director of Public Works. 3. That Condition Nos. 1 and 2, above mentioned, shall be complied with prior to final building and zoning inspections. 4a That the conversion of the existing structure shall conform to the Uniform Building Code as adopted by the City of Anaheim. ~o That any air conditioning facilities proposed shall be properly shielded from view from abutting street(s). 6. That ~ubject property shall be develope~9 substantially in accordarce with _ plans and spacifications on file with the City of Anaheim, marked Exhibit No. 1. 7. That the proposed nursery sha11 be operated 5 days a week from 8 A.M. to 6 P.M. and a maximum number of 30 children shall be permitted, as stipulated by the petitioner.
