71R-041 RESOLUTION NO. 71R-4l A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 1213. WHEREAS, the City Planning Commissi.on of the City of Anaheim did receive a request for a Conditional Use Permit from LEDGER T. and GLADYS K. SMITH, 151 Miramonte Drive, Fullerton, California 92632, OWners; RICHARD A. VA VERKA, 2542 North Pacific Avenue, Santa Ana, California, 92706, Agent, to establish a 222-space Travel Trailer Park in the M-l Zone with Waiver of Minimum Required Front Setback,. on the following described property: That portion of the land allotted to A.S. Van de Graaf in decree of partition of the Rancho Santiago de Santa Ana rendered in Case No. 1192 and entered September 12, 1868, in Book tlBU, Page 410 of Judgments of the Seven- teenth Judicial District Court of California, in the City of Anaheim, County of Orange, State of California, together with that portion of Lot 6 of the Travis Tract in said City, as per Map recorded in Book 5, page 120 of Miscellaneous Records, in the Office of the County Recorder of Los Angeles County, California described as a whole as follows: Beginning at the northeast te~inus of that certain course in the centerline of Katella Avenue, described as having a length of 767.89 feet in Parcel A of one Deed to the County of Orange, recorded in Book 3906, page 231, of Official Records in the Office of the Co.unty Re.corder of said Orange County; thence at ri.ght angles .to said certain course North 400 13' 41:1 West 60.00 feet t.o the exist.ing Nortnwesterly right-of-way line of Katella Avenue per Easement Deed recorded in Book 8167, page 632 of Official Records of said Orange County; thence along said North- westerly line South 490 461 19" West 70.76 feet to the true point of beginning; thence continuing along said Northwesterly line of said Kate11a Avenue, South 490 46' 1911 West 106.05 feet to an angle point therein; thence south 550 47' 38n West 311.48 feet to the Northerly line of the Santa Fe Railroad right-af-way; thence thereon North 690 59' 29u West 523.02 feet to the westerly line of said Rancho Santiago de Santa Ana; thence along said line of Rancho, l~orth 270 39' 30n East 174.84 feet to an angle point therein designated as SSA69; thence continuing along said westerly line, North 330 391 31u East 544.94 feet to a point in the existing southe.rly right-of-way line of Howell Ave., per Easement Deed recorded in Book 5251, page 8 of Official Records of said Orange County, said point being in a curve concave southerly and having a radius of 482 feet, a radial to said point bearing north 170 081 SOn East; thence along said avenue, through a central angle of 180 09' 43" and an arc length of 152.79 feet to the end of said curve, also being a point in the southerly line of Howell Ave. per Easement Deed recorded in Book 441, page 337 of Official Records of said Orange County; thence along said avenue, South 540 41' 27" East 376.82 feet to an intersection with the southwes.terly line of that certain parcel of land granted to the State of California per deed recorded in Book 7249, page 767 of Official Records of said Orange County; thence along -1- said State Highway right-of-way, South 360 03' 1511 East 22.36 feet to the west line of said Lot 6 of Tr.avis Tract and the westerly end of Struck Avenue, per Easement .Deed recorded in Book 611, page 11 of Official Records of said Orange County; thence thereon south 330 39 I 3111 wes"t 23.81 feet to the southerly right-of-way line of said Struck Avenue; thence thereon south 880 53' 5ln east 28.02 feet to said southwesterly line of State .Highway right-of-way; thence thereon south 360 03' 1511 east 1.99 feet to the northwesterly line of that certain parcel of land deeded to Shell Oil Company; thence thereon south 490 46' 19" west 150.40 feet to southwesterly line of said land; thence thereon south 360 03' 15:' east 150.40 feet to the true point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request. on November 30, 1970, notices of which said public hearing were duly given as required by law and the. provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Codei and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports. offered at said hearing, did adopt is Resolution No. PC 70-216 denying Conditional Use Pe~it No. 1213; and . WHEREAS, thereafter, within twen.ty-two (2.2) days from the date of the adoption of said resolution, a written appeal was filed with the City Council prete.sting the action of the City Planning Commission in denying said Conditional Use Permit and said appeal was set for public hearing on January 19, 1971, and continued to February 2, 1971, at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly ho.ld and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Commission and all evi.dence and reports offered at said" hearing, that Conditional Use Permit No. 1213 should be denied. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Com- mission denying Conditional Use Permit No. 1213 be, and the same is hereby sustained, and that the request of Ledger T. and Gladys K. Smith, Owners, and Richard A.
