P~66-162 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT 9~1 BE GRANTED ~~~ i ~~~ :I' i i.. ~ ~ ' WHEREAS, the City Plenning Commission of the City of Maheim did receive a verified Petition for Conditionel Use Permit from JESSIE L. GOODMAN, 716 South Webster Avenue, Anaheim, California 92~04, Owner; JULIA BRACHT, 505 Lakeside Drive, Fullerton, California 92632, Agent of certain real property situated in the Cit~ ~~ Anaheim, County of Orange, State of California, described as Lot No. 13 ~f Tract No. 796 ; and WHEREAS, the City Plenning Commission did hold a public heering at the City Hell in the City of Anaheim on December 5, 1~56~ at 2:00 o'clock P.M., notice of seid public hearing having been duly given as required by law and in accordsnce with the provisions of the Aneheim Municipal code, Chapter 18.64, to hear and cor.sider evidence for and ageinst said proposed conditionel use end to investigate and make findings and recommendetions in connection therewith; and WHEREAS, said Commission, e{ter dae inspection, investigation, end study made by itself end in its behalf, and after due consideretion of all evidence snd repoRs offered at said hearing, does find end determine the following fects: 1. That the proposed usc is properly one for which a Conditionel .Use Permit is authorized by this Code, to wit: Section 1R,64.~20(1-f) to permit operation of a private educational institution in an existing structure on subject property. 2. That the proposed use will not edversely afEect the adjoining land uses and the growth and develupment of the erea in which it is proposed to be located. 3. That the size and shepe of the site prorrosed for the use is adequete to allow the full development ofthe proposed use th a menner not detrimenta] to the particuler area nor to the peace, health, safety, end generel welfere of the Citizens of the City of Anaheim. 4. That the grenting of the Conditionel Use permit under the conditions imposed, if any, will not be detrimental to the peace, heelth, sefety, end general welfare of the Citizens of the City of Aneheim. 5. T;iat due to the lack of development of the properties along Webster Avenue, the posting of a two-year bond in lieu of the requirement of sidewalks and driveways is deemed appropriate. o. That subject prope:ty is provided adequately with fences or walls and shubbery to separate the proposed use from adjoining properties, and to act as a buffer for noises associated with the school playground. 7. That no one appeared in opposition to subject petition. Cl-G i . -1- 9 S NOW, THEFFEFORE, HE IT RESOLVED that the M~heim City Plonnina Commtosion does her'by grant subject Petltion for Conditfonel Uae Permit, upon the tollowing conditions which nre ha~bq found to be ~ neeesoary prerequislte to the proposed use of the subject property ;n order to pe~serve the safety and 6enecal welEare of the Citizerts of the Clty of An~neim: la That the owner of subject property shall pay to the City of Anaheim the sum of 15¢ per front foot along Webster Avenue, for tree planting purposes. 2. That a two-year bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of sidewalks and driveways along Webster Avenue, as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. 3. That Condition Nos. 1 and 2, above mentioned, shall be complied with prior to the time that the Building Permit is issued or within a period of 1R0 days from date hereof, whichever occurs first, or such further time a:~ the Commission or City Council may grant. 4. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 5. That the conversion of the existing structure shall conform to the Uniform Building Code, as adopted by the City of Anaheim. 6. That Condition Nos. 4 and 5, above mentioned, shall be complied with prior to final building and zoning inspections. 7. That subject oroperty shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit Nos. 1 and 2.
