PC 66-163RESOLUTION NO PC66-163 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAIiEIM THAT PETITION FOR CONDITIONAL USE PERMIT 902 BE GRANTED WHEREAS, the City Plenning Commission of the City of Anaheim did receive a verified Petition for Conditionel Use Permitfrom ECYNARD HARPSTRITE, % DOLLY L. BUTLER, 1647 West Beverly Boulevard, Los Angeles, California 90026, Owners; THOMAS HOFFPAUIR, 2001 Sabrina Terrace, Corona Del Mar, California 92625, Agent of certain real property situated in the City of Fnaheim, County of Orange, State of California, desci•ibed as Lot Nos. 10, 11, 12 and 13 in Block "C" of the Center Tract, as per map recorded in Book 14, page 13 of Miscellaneous Records of Los Angeles County, California ; and WHEREAS, the City Plenning Commission did hold a public hearing aE the City Hsll in the City of Aneheim on December 5, 1966~ at 2:00 o'clock P.M., notice of said public hearing having been duly given es required by law nnd in accordance with the provisions of the Aneheim Municipel code, Chapter 18.64, to hear and consider evidence for end egainst seid proposed conditianul use and to investigate and make findings and recommendetions in connection therewith; and WHEREnS, ~aid Commissian, efter due inspection, investigation, end study mede by itself end in its behelf, and after due consideration of all evidence and tepotts offered at said hearing, does Eind and determine the following facts: 1. That the proposed use is properly one for which a Conditional .Use Permit is euthorized by this Code, to wit:Section 1R.64.020(3-j-3) to permit the construction of a walk-up, drive-thzu restaurant on subject property. 2. That the proposed use will not edversely affect the adjoining lend uses end the growth aad development of the area in which it is proposed to be located. 3. That the size end shape of the site proposed for the use is edequete to allow the full development oE the proposed use in n manner not detrimental to the pacticuler aree nor to the peace, health, safety, and general welfare of the Citizens of the City of Maheim. 4. That the grenting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety, end generel welfare of the Citizens of the City of Aneheim. 5. That bec'ause of the location of the proposed use within the Center City Area, land- scaping in accordance with the site development standards o: the C-1 Zone is warranted. 6. That th? deletion of the proposed 12-foot access drive, adja~ent ±o the existir~g alley, is necessary for traffi.c safety and control. . 7. That Condition Nos. 3 and 4, above mentioned, shall be complied with prior to final ~ building and zoning inspections. '',~ 7. That subject property shall be deve:oped substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit Nos. 1, 2, 's, and 5, provided, however, that the proposed 12-foot access drive on the easterly property line shall be deleted, anci that all landscaping proposed for subject property shall be in conformance with the site development standards of the C-1 Zone.
