A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT 903 gE GRANTED ~ N'HEREAS, the City Plenning Commission oE the City o: Anaheim did rec~ive a verified Petition for Conditionel Use Permitfrom PACIFIC UNION CONFERENC,E OF SEVENTH DAY ADVENTIST, Box 146, Glendale, California 912U9, Owners; HFRITAGE Q~NSTRUCTION CORPORATTON, 4100 West Commonwealth, Fullerton, California 92633, Agent of certain real property situated in the City of Anaheim, County of Urange, State ~ of California, described i~ Exhibit "A" attached hereto and referred to herein as though set forth in full ; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hell in the City of Aneheim on December 5, 1966, at 2:00 o'clock P.M., no:ice of said public hearing heving been duly given es required by law end in accordence with the provisions of the Aneheim Municipel code, Chepter 18.64„fo hear and consider evidence for and against seid proposed conditional use end to investigate end meke findings end recommendations in connection therewith; and WHEREAS, seid Commission, efter due inspection, investigetion, and study mede by itself end in its behelf, and after due consideretion of ell evidence and reports offeted at said hearing, does find end determine the following facts: 1. The the prooosed use is prooerly one for which a Conditional Use Permit is authorized by Code: Section 1R.64.C20(2-c) and 1R.64.020(5) to construct a:notel and restaurant complex with waiver of: SEG7ION 1R.40.:~70(4) Required parhing (R2 spaces required-7fi spaces prooosed) 2. Thet the proposed use will not adversely effect the adjoining land uses and the gtawth and development of the aree in which it is proposed to be loceted. 3. Thet the size and shape of the site proposed for the use is edequete to allow the full development of the proposed use in a manner not detrimental to the particular aree nor to the peace, heelth, sefety, end generel welfere of the Citizer.s of the City of Anaheim. 4. That the granting of the Conditionel Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, sefety, end general welfere of the Citizens of the City of Aneheim. 5. That the petitioner stipulated to reduction of the motel strur.t~re by four units, and relocation of the structure easterly to provide for adequate automobile `urning radius; and a minimum required 15-foot landscaped setback along Harbor Boulevard. 6. That under the authority of Section 1R,64.070, waiver of the required 7~i parking .spaces to permit development of the motel-restaurant complex with 75 oarking spaces is hereby granted. 7. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Harbor Boulevard, for street lighting purposes. 2. That the uwners of subject property shall pay to the City of Anaheim the sum of 15~ per front foot aiong Harbor Boulevard, for tree planting purposes. 3. That trash s~orage areas shall be provided in accordanc~, with approved pla;is on file with the office of the Director of Public Works. 4, That fire hydrants shall be installed as required and rletermined to be necessary by ~ the Chief of the Fire Department. ~~q~ 5. That any air-conditioning facilities proposed shall be properly shielded from view. ~;•~~ 6. That Condition Nos. 1 and 2, above mentioned, shall be complied ~.vith p:ior to the time that the Building Permit is issued or within a period of 1R0 days from data hereof, ~;.': whichever occurs first, or such further time as the Commission or Ci~y Council may y.rant. 7. That Condition Nos. 3, 4, and 5, above mentioned, shall be co^~plied with pr`.or to final building and zoning inspection~. '% ~. That subject property shall be developed substantially in a~.cordance with pla~~s and _.;~: specifications on file with the City of Anaheim, marked Exhibit Ncs. 1, 2, 3, 4, ano 5, provided, however, that the structure for the motel shall be reduced by four units, ar~d re- located easterly, in order to provide for an adequate automobile turning radius and a minimum 15-foot strip of landscaping along the Harbor Boulevard frontage, as stipulated by the ~;, petitioner.
