A RESOLUTION OF THE CITY PLANNING COMMISSION OF Tf~Fb CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT NO. 5BE DENIED ~" -•'~'~ ~~~ , W13EREAS, the City Plenning Commission of the City of Aneheim did receiv~. a verified Petition for Conditional Use Permitfrom EARL SPRATLEN, 461 West Valley View Drive, Fullerton, California, HECTOR PEi.AYO, 232 San Carlos Way, Placentia, California, Owners; WILLIAM TOPLIKAR, 3505 Mungall Drive, Anaheim, California, Agent of certain real property situated in the City of Anaheim,. County of Orange, State of California, described as Lots 43 and 44, Tract 2022, as shown on a map thereof recorded in book 58, pages 24 and 25, Miscellaneous Maps, recorcis of said Orange County ; and WHEF.EAS, the City Planning Commisaion did hold a public hearing at the City Hell in the City oE Aneheim on December 19, 1966, at 2:00 o'clock P.M., notice of seid public hearing heving been duly given es requiced by lew end in eccordance with the provisions of the Maheim Municipal Code, Chepter 18.64, to hear and consider evidence for end egainst said propos..d rnnditional use and to investigate and make findings and recommendatlons in connection therewith; end WHEREAS, seid Commission, after due inspection, investigetion, and study made by itself end in its behalf, end efter due consideretion of all evidence and reports offered at said hearing, does find end deteanine the following fects: 1. That the proposed use is p~opetly one for ahich e Conditionel Use Permit is euthorized by this Code, to wit: Sectiors 1fl.40.0601c) and 1R.64,020(5) to establish a service station at the intersection of a seco~dary and a local street, and within 75 feet of a residential zone, with waiver of: SECTION 1F~.40.070(3-a) - Building height in relation to setback. (2:1 ratio of setbach to building height would require a 30-foot setback from 'he rear property line for the 15-foot high proposed biiilding; no setback proposed). tt ' ~. ~ ,f.l * :-i ~ 2. That the proposed use will adversely af:ect the adjoining residen:ial iand uses ano the growth and development of the area in which it is proposed to be located. 3. That the size and shape of the site proposed for the use is not adequate to allow the iull development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and gener ' welfare of the ~itizens of the City o; Anaheim. 4. That the request for waiver of the r~__;uired building setback would have a deleterious effect on the residents to the east since a 15-foot building located on the easterly property line would depiive the adjace!~t resid?nts of th_ normal use of their rear yards and svaimmir~g pools. 5. That th? dust, noise, bright lights, fumes, and hours of operation, inherent in this type of use would effectively destroy the residential integrity of the area. . 6. That service stations usually require access from both streets of the intersection on which they are located which would generate commercial traffic onto a local residential street, thereby creating additional points of traffic confiict and congestion for the residents of the area. 7. That three persons appeared representing seven persons present in the Council Chamber opposing subject petition.
