P~66-175 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM i' RECOMMENDING TO THE CITY COUNCiL OF THE CITY OF ANAHEIM THAT PETITION FOR RECLASSTFICATION NO. 66-67-44 HE AppROVED WHEREAS, the City Plenning Commission of the City of Anaheim did recelve a verified Petition for Reclassifica- tionfrom EUGENE 0. AND MARY G. HOLABIRD, 2R40 West Lincoln, Anaheim, California, Owners; ED GENTILE, 135 Land Lane, Anaheim, California, Agent of certain real property situated in ihe City of Anaheim, County of Orange, State of California, described as the North 316.00 feet 'j~~ of the West 72.775 feet of the East 362.775 feet of the West 6 acres of the North 10 acres of ~~ the East 13 acres of the East 13 acres of the North 18 acres of the East 30 acres of the ~ Northeast quarter of the Northwest quarter of Section 13, Township 4 South, Range 11 West, 1' ` in the Rancho Los Coyotes, as shown on a map recorded in book 5i, page 11, Miscellaneous ~ Maps, records of said Orange County; EXCEPTING THEREFROM the North 66 feet as conveyed to ~ the State of California by deed recorded February 14, 1955, in book 2957, page 225, Official Records ; and DecembeHEREpSi9th~ City Plenning Commission did hold a public hearing et the City Hall in the City of Aneheim on 19 b~ at 2:00 o'clock P.M. notice of said public hearing having been duly given es required by law and in accordence with the provisions of the Anaheim Municipal Code, Chepter l8,72, to hear end consider evidence for and ageinst seid p~oposed reclassificetion end to investigete and meke findings end recommendations in connection therewith; and WIiEREAS, seid Commission, after duc inspection, investigetion, end study made by itself end in its behelf, end efter due consideretion of all evidence and repotts offered at said hearing, does find and determine the following fects: 1. That the petitioner proposes a reclessification of the ebove described property from the R-A, Agricultural, Zon¢: to the C-1, General Comrnercial, Zone to utilize an existin9 structure for loan, real estate, and insurance offices. 2. That the proposed reclassification is in conformance with the General Plan. 3. Thet the proposed ceclaesification of subject property is necessary and/or desirable for the arderly and pro- per developnrent of the community. 4. Thet the proposed reclessificetion of subject propecty does properly relate to the zones end their permitted uses locally esteblished in clo~e proximity to subject property end to the zones and their permitted uses generally esteb- lished throughout the community. ) property does not require dedication but does5requiretimppo~ement ofcabuttingastreets inbaccordance with the Circulation Element of the General Plan, due to the anticipated increase in traffic which will be generated by the intensification of land use. 6. That no one appeared in opposition to subject petition. ~ ~ ~'j R"A -1- J ~ ' NOW, THEREFORE, BE IT RESOLVED th~t the An~heim City Planning Com~iasion does hereby recommend to the City Council of the City of Aneheim that aubject Petitlon for Recl~a~iHcation be approved end, by so doing, thet Title 1&Zoning a4' the Aneheim Municipel Code be amended to exclude the ~bove described property from the R-A, Agricultural, Zone and to incorporate said desc.r.ibed Property into the C-1, General Commercial, Zone, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim. 1. That st*eet improvement plans shall be prepared and all engineering requirements of the City of Anaheim along Lincoln Avenue, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be completed as required by the City Engineer and in accordance with standard plzns and specifications on file in the office of the City Engineer; or that a bono in an amount and form satisfactory to the City of Ar~heim shall be posted with the City to guarantee the installation of said engineering requirements. 2. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot alon~ Lincoln Avenue, for street lighting purposes. 3. That the owners of subject property shall pay to the City of Anzheim the sum of 15¢ per front foot along Lincoln Avenue, for tree planting purposes. 4. That Condition Nos. 1, 2, and 3, above mentioned, shall be complied with within a period of 1R0 days from the date hereof, or such further time as the City Council may grant.
