PC 66-34RESOLUTION NO. °~66-34 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM RECC~MMENDING TO THE C1TY COUNCIL OF THE CITY OF ANAHEIM THAT PIiTIT10N FOR RECLASSIFICATION N0. 66-67-6 HE APPROVED WHEREAS, the City Plenning Commission of the City of Anaheim did receive a verified petition for Reclessifica- tionfrom P,AY BRADEN, 400 West Knepp Street, F~llerton, California; WILLIAM CHANDLEE, Box 3244, Anaheim, California; HERBERT NL-WSOME, 2172 West Cerritos Avenue; and WILLIAM KROGSDALE, 2168 West Cerritos Avenue, Ar.aheim, California, Owners; JOSEPHINE CHANDLEt, P. 0. Box 3244, Anaheim, California, Agent of certain real property situated in the City of Anaheim, County of Orange, Sta+a of California, d?scribed as Lot Nos. !, 2, 3, and 4 of Tract IJo~ 2015, as Per map recorded in book 58 pages 16 ond 17 of Pfiscellaneous Maps, in the office of the county recorder of said county ; end WHEREAS, the City Planning Comrt~ission did hold a public hearing et the City Hall in the City o( Anaheim an August 1, 1956, at 2:00 o'clock P.M. notice oE seid public hearing having been duly given es required by !.aw and in eccordence with the provisions of the Anaheim Municipal Code, Chepter 18.72, to heer end consider evidence for end against seid proposed reclassitication end to investigate and make findings and recommendetions in connection therewith; and WHEREAS, said Commission, efter due inspection, investigation, and study mede by itself end in its behelf, and efter due conaideration of all evidence end reports offered et said hearing, does find and determine the following fects: 1. That the petitioner proposes e reclessification of the obove described property irom the R-1, UNE-FHMILY RESIDENTIAL, ZOiJE to the C-i, GEPJ'eRAL COI,~McRCIAL, 'LOIJE to establish a s?rvice station and convAnience shopping c?ntAr on subject prope.rty, 2 fhat the scepe of the proposed r?classification, if approvad, doas not warrant an amendment to th? Gon?ral Plan at the present timA; however, its rAlationship to the existing r,oneral Plan symbol will be cons:dered at th? nAxt ar.nual reviaw~ 3. That the Qcoposed reclassificetion oE subject property is necessery end/or desireble (or the orderly end pro- per developr.rent oE the community. 4. Thet the proposed reclassiEicetion of subject property does properly relate to the zones and their pecmitted uses locelly established in close proximity to subject property and to the zones and their permitted uses generelly esteb- lished throughout the community. 5. That the proposed reclassification of subject propArty rea~ires the dedication and improvoment of abu'±iny streets in accordanc? with the Circu:ation Element oE the G~neral Plan, due to the anticipated ircrease '_n traffic which will be g?nerated by the intensifica- tion of land use. h. That one porson appaared in oppos:tion, presenting a patition signed by 30 property own?rs also ir~ opposition, and that on? pPrson appeared in favor of subject petition. ~ ~ R-A -1- NOW, THEREFORE, BE IT RESOLVED that the Aneheim City Pl~nnine Commiasion does hereby recommend to the City Council of the City of Aneheim thet ~ub)ect PetitIon for ReclasaiEieatioa be epproved and, by so doing, that Title 1&2oning of the qneheim Municipe~l Code be nmended to exclude the above deacribed property from the R-'_, One•-Family Residential, Zone, and to incorporate said described property into the C-1, General Commezcial, Zone, upon the fc~llowing conditions which are hereby found to be a necessary prerequisite tu the proposr.d use of subject property in o:der to preserve the safety and general weifare of the cit:izens of the City of Anaheim: lo That the owners of subject F:~roperty shall deed to the City of Anaheim a strip of land 32 feet in width, from the cente~rline of the street, al.ong Cerritos Av?nue, for street wideninq purposes~ 2, That the owners of subject ~~roperty shali deed to the City of Anaheim a strip of land 60 feet in width, from the cente~rline of the street, along Brookhurst Street, includ- ing a 2:~-foot radius return, for street widening purposeso 3. That the owners of subject property shall pay to the City of Anaheim the sum of 15¢ per front foot along Brookhurst Street and Cerritos Avenue for tree planting purposeso 4~ That Condition Nos. 1, 2, and 3, above mentioned, shall be complied with within a period of 180 days from ttie date hAreof, or such iurther time as the City Council may grant. 5~ That any air-conditioning facilities proposed shall be properly shield?d frorn viAw from abutting streets and the seund buffer?d from adjac?nt rAsidential homes, prior to final building and zoniny inspActions.
