PC 66-38RESOLUTION N0. pC66-38 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF AN,=_HEIM THAT PETITIUN FOR CONDITIONAL USE PERMIT 868 BE GRANTED WHEREAS, the City planning Commiseion of the City of Meheim did receive a veriEied PetItion for Conditional Use Permitfrom CNARLES W. HUSHAW, 519 Peppertree Urive, Brea, California, and ROBERT J. CROFT, 638 South State College boulevard, Anaheim, California, Owners: GEORGE L. ARGYROS, 415 West 4th Street, Tustin, California, Agent of certain real propert~• situated in the City of Anaheim, County of Orange, State of California, described as Lots 8, 9, and 10 of Tract No. 2300, as shown on a Map recorded in Book 68, pages 35 ar~d 36 of Miscellaneous Maps, records of Orange County, California ; and WHEREAS, the City Plenning Commission did hold a public hearing et :he City Hcill in the City of Anaheim on August 1, 1966, at 2:00 o'clock P.M., notice of seid public hearing havin been dul law and in accordence with the provisions of the Aneheim Municipel code, Chepter 18.64, to heat e d eon det evidence for and egainst said proposed conditionel use end to investigete end meke findings end rernmmendationa in connection therewith; end WHEREAS, said Commissioo, efter due inspection, investigation, and study made by itself end in its behalf, end after due consideration of all evio'ence and reports offeced at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which e Conditional .Use Permit is euthorized by Cod?: Section 18.40.070(c) to establish a service station within 75 feet of an R-1, One-Family RAsid?ntial, Zone on subject property. 2. Thet the proposed uae will not edversely affect the adjoining land uses and the growth end developmmt ot the area in which it is proposed to be loceted. 3. That the size end shape of the site proposed for the use is edequate to allow the full development of the proposed use in e menner not detrimental to the perticuler area nor to the peace, health, safety, and general welfate of the Citizens of the City of Anaheim. 4. Thet the granting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety, end general welfere of the Citizens of the City of Aneheim. 5. That the petitioner stipulated to landscaping the northerly 35.69 feet of subjact property, sincA no development plans were pres?nted for that portiion of the property. 6. That no ono appeared in opposition tu subjAct patition. Cl-G _1_ ~ J C NOW, THEREFORE, BE IT RESULVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit, upon the iollowing conditions which ere hereby found to be a necessery pretequisite to the ptoposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the CIty of Aneheim: 1. That this t;onditional Use Permit is granted subject to the completion of Reclassification No. 66-67-7. 2. That all construction shall be in acco:dance to the Uniform Building Code as adopted by the City of Anaheim, 3. That subject property shall be developed substantially in accordance with adopted Service Station Minimum Site Development Standards. 4. That subject property shall bP developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit Nos. 1, 2, 3, 4, 5, 6, and 7; provided, however, that landscaping, including irrigation facilities, ~ sn~ll be installed and maintained in the northerly s5.69 feet of subject propert~, as ~ stipulated by the petitioner, prior to final building and zoning inspections.
