A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT NO. ~76BE DENIED WHEREAS, the City Planning Commission of the City of Anahelm did receive a verified Petition for Conditional Use Pcrmitfrom REUBEN TUCKER~ ET AL, 7U1 North Helena Street, Anaheim, California, Owner; JACK MILLER, 2545 East Chapman, Suite 1~, Fuilerton, California, Ayent of certain real property situated in the City of Anaheim, County of Orarge, State of California, described in Exhib:t "A" attached hereto and referred to herein as though set Forth in full ; and WHEF.EAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Aneheim on Auqust 29~ 1966 at 2:00 o'clock P.M., notice of seid public hearing having been duly given as required by law and in accordance with the provisions of the Aneheim Municipel Code, Chapter 18.64, to hear and consider evidence for and against said proposed conditional use and to investigate and make findings end recommendations in connection therewith; and Wf•~~EREAS, said Commission, after due inspection, investigation, and study mede by itself and in its behalE, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following fects: 1. 'I'het the prop osed use is properly one for which e Conditional Use Pertnit is authorized by this Code, to wit: Section 1f~,40~J60`g) to establish on-sale beer in conjunction witti the sale of food. 2. That the proposed use will adversely affect the adjoinina land uses and the orowth and development of the area in which it is proposed to be located. 3. That the proposed beer bar would have a deleterious afFect on the area due to the `act that children from the nearby schools and residences patronize the market shoppino area for scnool supplies, snacks, and convenience goods. 4, That the small. neighborhood shopping facility already provides :or oFf-szle liquor and the additicn of a be?r bar would not be an appropriate use of the prope:ty. 5a That the size and shape of the small neighborhood shopping center and the developmer.t plans of the proposed beer bar are not adequate to ailow the development of the proposed use 'in a manner not detrimental to this particular area nor to the peace, hea:.th, safet}~, and general welfare of the Citizens of the City of Anaheim. 6o Petitions bearing 351 signatures were presented in opposition to subject petitiono 7, That twenty prople appeared in opposition to subject petition.
