That the proposed use is properly one for which a Conditianal .Use Permit is authorized by this Code, to wit: Section 1Ro40~060(e) to establish a walk-up restaurant on subject property. 2. That the proposed use will not edversely aEfect the edjoining land uses aed the growth end development of the area in which it is proposed to be located. 3. That the size end shape of the site proposed for the use is edequate to allow the full development ofthe proposed use in e manner not detrimental to the particuler erea nor to the peace, health, sefety, and generel welfare of the Citizens of the City of Meheim. 4. That the granting of the Conditionel Use Permit under the conditions imposed, if any, wi(l not be detrimental to the peace, health, safety, end general we!(are of the Citizens of the City of Aneheim. 5~ That nd one appeared in ~pposition to subject petition. I~~ ~~ ~~ 1 NO'N, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby =lrant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequis;te to the proposed use of the subject property in oxder to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That street improvement plans shall be prepared and all er.gineering requirements of the City of Anaheim along Lincoln Avenue and Gilbert Street, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities or other appurtenant work shall be completed as required by the the City Engineer and in accox•dance with standard plans and specifications on file in the office of the City Engineer; and that a bond in ar; amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineerir~ requirements. 2. That the owners of subject property shall pay to the City of Anaheim the sum of $2.~0 per f~ont foot along Lincoln Avenue and Gilbert Streety for street lighting purposes~ 3~ That the uwners of subject property shall pay to the City of Anaheim t}~e sum of 15a per f'ront foot along Lincoln Avenue and Gilbert Street, for tree planting purposes. 4~ That a Parce: Map to record the approved division of subject property be submitted to the City of Anaheim for approval and then be recorded in the office of the Orange County Recorder. 5. That a document snall be recorded, quaranteeing inutual ingress and egress to the inte- grated parking areas, and that no walls, fences, or other physical barriers shall be constructed within the shopping facility that would restrict the flow of vehicular traffic in and on the facility's par}:ing areas or accessways. 6. That Condition f4os. lY 2, 3, 4, and _, above mentioned, sha11 be complied with prior to the time th~t the Buiiding Permit is issued or within a period of 1R0 days from date hereof, whicnever occurs r'irst, or such further time as t}ie Commission or City Council may arant. 7, That trash storage areas shall be provided in accordance with approved plans on file with the off'ice of the Director of Public Works.
