PC 66-73RESOLUTION N0. p~66-73 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT RR3 SE GRANTED WHEREAS, the City Plenning Commiseion oE the City of An~helm did ceceive e verified Petition for Conditionel Use Permitfrom FREDRICKS DEVELOPNEM CORFORATION, 524 VJest Commonwealth, Fullerton, California, Owners of certain real property situated in the City of Anaheim, County of Orange, State of California, described as the westerly 125.00 feet of the most southerly 150,00 feet of Lot 34 of Tract Noa 4757, as per map recorded in book 1R4 pages 47 and 4R of Miscellaneous N~aps, ~I in the office of the county recorder of said county ; and WHEREAS, the City Plenning Commission did hold a public hearing et the City Hall in the City of Aneheim on September :~, 1966, et 2:00 o'clock P.M., noticc of seid public hearing having been duly given as required by lew end in accordance with the provisions of the Aneheim Municipel code, Chepter 18.64, to hear and consider evidrnce for and egeinst seid proposed cronditional use and to inveatigate and meke findings and recommendations in connection therewith; and WHEREAS, said Commission, efter due inspection, investigetion, and study mede by itself and in its behelf, end after due consideration of all evidence end repods ofEered et said hearing, does find and determine the following fects: 1. Thet the proposed use is properly one for which e Conditional .Use Permit is euthorized by this Code, to wit: Section 1R,-^.0.,060(e) to establish a wai};-up restaurant ~n subject property. I 2. Thot the proposed use will not edversely affect the edjoining l~nd uses and the growth and development of the area in which it is proposed to be loceted. 3. That the size and shape of the site proposed for the use is edequate to allow the full development of the proposed use in e menner not detrimentel to the particuler area nor to the peace, health, safety, end general welfare of the Citizens of the City of Anaheim. 4. Thet the granting of the Conditional Use Permit under the conditions impased, if any, will not be detrimentel to the peace, health, safety, end general welEere of the Citizens of the City of Aneheim. 5.. That no•one appea:ed in ooposition to subject petition. ~ ; Cl-G i _~ ' I ~ ~ ~ ~:1 -1- ~ b NOW, THEREFORE, HE IT RESOLVED thet the Aneheim City Plenning Commission does hereby grent subject Petition for Conditionel Use Permit, upon the following conditions which are hereby found to be e necessary prerequisite to the proposed use oE the subject property in order to preserve the safety and generel wel[ere of the Citizens of the City of Aneheim: le That trash storage areas shall be provid~d in accordance with approved pizns on file with the office of the Director oF Pub;ii: Works. :?, That any air-ccnditionir.g f~cilities proposed shall be properly shielded from view :rom abuiting streets., 3~ That Condition Nos~ 1 and 2, above mentioned9 shali be complied with prior tc final building an~ zonir.g ir.spar:`~nsa 4, That subject pro~.-:ty stiall be deveioped substantially in accordance with plans and specifica+ions on file witt~ the City of Anaheim, marked Exhibit No=o 19 L, 3, and 4, provided that the },arking layout for the proposed walk-up restaurant shall be int?grated in*o the parking layout for the entize shopping ~.enter. 5~ That a document shall be recorded, guaranteeing mutuai ir~gress and egress to the ?ntegrated parF:ing areas, and tnat ro walis, fences or other physical bar~iers shall be construct•- '. ed within the shopping i~cility lt;3t would restrict the fiow of vehicular traffic in and on the ' fiaciliiy's par}:ing areas or acces;~n~ays~ _ 6., Tnat a Parcel h1ap ?o record the approved division of subject property be submitted t'~e~ City of Anaheim fo: app:ovai and then be recorded in the office of the Oranoe County •acorder~ 7, That Condition Nosa 5 and 6, ab~ve mentioned, shall be complied with ~rior to the time , that the Building Permit is issued or within a period of 1~0 days from date hereof, whichever oc~.urs first, cc such 'urther time as the Commission or City Council may grant.
