PC56-75 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 1~26 HE GRAIJTEb IN PART _rs~~, 'i~ I~ , WHEREAS, the City Planning Commission ot the City of Anaheim did receive a veri.`ied Petition for Variance from GULF OIL CORPORATION, 1ROi Avenue of the Stars, Los Anaeles, Caliiornia, Owners; MICNIELSEN AND ASSOCIATES, 2°.0 ~orth Wilshire Avenue, Anaheim, California, Agent of certain real property situated in the City of Anaheim, County of Orange9 State of California, described as be9inning at the intersection of the Westerly line of Adelaide Strpet (now known as Helena Street) 60,00 feet in width, as shown un a map of tne New Subdivision of said Lct D-5, recorded in booh 17~ page 72, Miscelianeous Recorda of Los Angeles County, v.ith the northeriy line of the land described in a deed to the City of Anaheim recorded August 16, 1920, in book 3ii, pa9e 162, Deeds, thence West- erly along said Northerly .i.ne of the land of the Citv of Anaheim, 110.00 feet to the Easterly line of Lot 2R, Blo~k H in said New Subdivision of Lot D-5y; thence Northerly along said Easterly line of Lot 2R, a distance of 7.41.25 feet to the Northessterly corner of said Lot 2R; thence casterly along the Easterly prolongation of the Northerly ].ine of said Lot 2R, a distance of 1:Oo00 *~et to sai~ Westerly line oi' Advlaide St:eet• thence Scutherly along said tiNesterly line, i41.25 feet to the point of beginning ' ; end WHEREAS, the City Planning Commission did hold a public hearing et the City Hell in the City of Anaheim on Septemb~r 129 1966~ at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by !aw and in acoordance with the provisions ot the Anaheim Municipal Code, Chapter 18.68, to hear and con~ider evidence for and against said proposed variance and to investigete end make findings and recommendations in connection therewith; and WHEREAS, said Commission, eEter due inspection, investigation, and study made by itselE and in its behalf, end efter due consideretion of all evidenc~ and reports offered ot seid hearing, does find and detetmine the Following facts: 1. Thet the petitioner requests e variance from the Anaheim Municipel Code: to permit erection of a free- standing sign on ,ubject propertyo SECTi0P1 ~p.,~;2,p_ qp(p_2) - height of a free-standing sign (25 foot maximum sign neight permitted within 300 :_et of a structure used exclusively for residential purposes; a0 foot high sign proposed). SECTIGN 18~62 090~B-5) - location of a si9n adjacent to a p;operty line (44 foot setback irom the west property line raqui:ed; 3 foot setback proposed)a 2> That no harship was proven to war:ant granting a waiver of the maximum sign height. 3~ That the sign for the bank property to east of subject property would be blocked if the requested waiver of the maximum ;ig~ height was granted; therefore, the waiver of Section 1P,.62o090(B-2) is hereby deniedo 4o That the requested variance, as granted, wili •,velfare or injurious to the property or improvemen property is iocated~ 5. IN PART NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Plenning Commission does hereby grant subject Petition for Variance, upon the following conditions which ere hereby found to be a necessary prerequisite ta the pro- posed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim. la ?hat the free-standin9 sign shall be relocated in accordance with Exhibit IJoo 1, on file with the City of Anaheim, provided, however, i:hat the height of the sign shall conform with requirements of the Sign Ordinance or 25 feet.
