PC67-55 GRANTING ~NDITIONAL USc PERMIT N0, 927 THEReTO WHEREAS, the City Planning Commission in Resolution No. PC67-55 dated March 13, 1967 granted Conditional Use Permit No. 927, subject to conditions; and WHEREAS, Cor.~ition No. 15 requirea that t;~e cuts and slopes be mainta:ned at all times at a 3 to 1 ratio (3 ;eet horizontal to 1 ioot vertical) alonq the west, north and east p:oper;:y lines to retain the stability of the soil and prevent soil erosion; and WHEREAS, public he~ring before the City Council has been continued to July 18, 1967, to allow time for a discussion betv;een the petitioner and the Orange County 'Nater District regarding the cuts and slooes ana :uture use of the pit, as well as a reoort from the City Engineer relative to the acceptability o; the orotiosed cuts and slopes on subject oroperty; and WHEREAS, the Orange Count} '~"later District has advised the Deve?opment Services Deoartment and Engineering Department oi i~e City of Anaheim they were negotiating for eventual use o: the subject oroperty ~s a future settling basin and recreation area, and a 1; to i slooe ratio along the north and east property lines would be acceptable for the proposed use oi the property after excavation oi the minerals had taken olace; and WHEREASS the City Engineer, in a Report to the Commission, also veri.`ied that a 1~;- io i slope ratio would be acceptable on the north and east slopes, provided that a horizontal distance from the~ top of the slooe to the north property line and also the rioht-or-~~;ay lin~ of Richfield Road be maintained ac a minimum of 50 feet; and further provided, that a 3 to 1 slope is maintained at the specified distance from the ~~etropolitian Water District line along the west property line. ~.! ~ * ~ NOW, THEREFORE, BE IT RESOLVED that the City Planning Comm~ssion of the City of P.naheim does hereby amend Resolution ^:o. PC67-55, granting Condition ,e Permit ,]o. 927, Condition No. 15 to read as follows: "15. That in order to retain the stability of the so 1 and orevent soil erosion, all cuts and sloping shall be maintained at ali times alono ~he west prDOerty line at a 3 to 1 ratio (3 feet horizontal to 1;oot vertical), with tne top o` the slopiny commencing at a minimum of 110 ieet `rom the west orooerty line; and a 1;- to 1 fo~t along the north and east property line; orovideo, however, that said slooe be maintained a minimum o' 50 ;eet from botn the north property line and the west right-of-way line o: Richrield Road as a condition of use, and that said slooes shall be maintained v;ith natural material in or~er that any future reuse o` the excavated oit may be ac- complisheo with a minimum expenditure."
