P~67-149 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM RECOMMENDING TO THE CITY COUNCIL Ol~' THE CITY OF ANAHEIM THAT PETITION FOR RECLASSIFICATION NO. 67-68-1 BE APPROVED WHEREAS, the City PSenning Commission oE the City of Anaheim did receive a verified Petition for Reclassifice- tionfrom ANNIE TORRES, 3435 West Ball Road, Anaheim, California 92804, Owner; M. S. BERNARD, 615 West Eighth Street, Santa Ana, California, Agent of certain real property situated in the City ~~i---~~ of Anaheim, County of Orange, State of California, described as the West 85.00 feet of the Hast ~,. ' 395.00 feet of the southwest quarter of the southwest quarter of the southwest quarter of szctic,~ ~f 14, Tcwnship 4 South, Range 11 69est in the Rancho Los Coyotes, as said section is shown on a mao ~.~~ recorded in book 51, page 11 of Miscellaneous Maps, in the office of the county recorder of said county. EXCEPT the North 264.00 feet thereof ~; , ; and ~ WHEREAS, the City Planning Commission did hold a public hearing et the City Hell in the City of Aneheim on July 6~ 1967, at 2:00 o'clock P.M. notice of said public hearing heving been duly given es required by lew end in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.72, to hear and consider evidence ~ _ 1 _ for and against seid proposed reclassification and to investigate and make findings end rernmmendetions in connection ~' I therewith; end I ~ i WHEREAS, said Commission, efter due inspection, investigation, end study mede by itself and in its behelf, and .. i efter due consideration of all evidence and repods offered at said hearing, does find and determine the following (acts: ;i [:~ 1. Thet the petitioner proposes a reclassification of the above described property from the R-A, Agricultural, i;, Zone to the G 1, General Commercial, Zone to utilize an existing residence for expansion of `~ the medical offices to the west, and for parking purposes. ~;i 2. That the scope of the proposed reclassificat~on, if approved, does not warrant an i~ amendment to the General Plan at the present ti~ne, however, its relztionshio to the General I Plan symbol will be considered at the next annual review. ~ i f • E ~' I ~, I ; 3. That the proposed reclassificetion of subject property is necessary and/or desirable [or the orderly end pro- ! per developm~ent of the community. 4. Thet the proposed reclessification cr subject property does properly relale to the zones end their permitted i; uses locelly established in close proximity to subject property and to the zonas and their permitted uses generally esteb- lished throughout the community. •- 5. That the proposed reclassification of subject property requires the dedication and irnprovement of abutting streets in accordance with the Circulation Element of the General Plan, due to the anticioated increase in traffic which will be generated by the intensification of land use. ,~~ 6. That one person appeared requesting clarification as to proper seoaration of the ,~ residential use since t,er home abutted subject property to the rear. ;I - ;~ ~ ~ ,~ ,at~ ~ ~ .~ R-A -1- ~i ,~ ~ NC1W, THEREFORE, BE IT 's2ESOLVED thet the Aneheim City Plenning Commission does hereby cecommend to the City Council of the City of Aneheim thet subject Petitlon for Reclessification be epproved and, by so doing, thet Title 18-Zoning of the Anaheim Municipal Code be emended to exclude the ebove described pc: perty from the R-~A, Aaricultural, Zone and to incorporate said described property into the C-1, Genesal CommerciaL Zone ~„pon the following conditions which are hereby found to be a necessary prerequisite to the . proposed use of subject property in order to preserve the safety and general welare of the citizens of the City of Anaheim. le That the owner of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Ball Road, for street widening purposes. 2. That street improvement plans shall be prepared and all engineering requirement: of the City of Anaheim along Ball Road, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other app>>rtenant work shall be compl~ted as required by the City ~ngineer and in accordance with standard plans and specifications on file in the office o: the City - Engineer; and that a bond in an aR~ount and form satisfactory to the City of Anaheim shall be posted i+.S~ with the City to guarantee the installation of said engineering requirements. 3. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Ball Road, for street lighting purposes. 4. That the owner of subject property shall pay to the City oF Anaheim the sum of 15~ per front fcot along Ball Road, for tree planting purposes. 5a That trash storage areas shall be provided in accordance with approved plan= on fiie with the office of the Director of Public Works. 6. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 7. That Condition Nos. 1, 2, 3, and 4, above mentioned, shall be complied with within a oeriod of 180 days from date hereo:, or such further time as the City Council may grant. 8. That the conversion of the existing structure for a commercial use shall be in accordance with the Uniform Building Code, and the site development standards of the C-1 Zone as adopted by the City of Anaheim. °. That Condition ~dos. 59 6, and 8, above mentioned, shall be complied with pricr to final building and zoning inspections.
