PC 67-152RESOLUTION NO PC67-152 A RESOLUTION OF THF CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE NO. 1895 BE GRANTED WHEREAS, the City Planning Commission of the City of Aneheim did receive a verified Petition for Veriance from JANE MARIE CARPENTER AND HOWARD FREISS, 1172 Cherry Way, Anaheim, California ~~°O1, Owners; GORDON FITZPATRICK, 1123 West Lincoln, Anaheim, California 92805, Agent of certain rezl property situated in the City of Anaheim, County of Orange, State of California, described as the North 120.00 feet oi ths South 241.00 feet of the North 491.00 feet of the East 122.40 feet of tha~ ~~~ portion of section 4, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, ,;; shown as lot 5 on a map filed in book 1 page 55 Record of Surveys, in the office of the county F~4 ~ recorder of said county ; and WHEREAS, the City Plenning Commiss;on did hold a public hearing at the City Hall in the City of Aneheim an July 6, 1967~ at 2:00 o'clock P.M., notice of said public hearing having been duly given es required by law and in eccordance with the provisions of the Meheim Municipal Code, Chaptet 18.68,to hear and consider evidence for end egainst said proposed variance and to investigete and meke Eindings er 'recommendations,in connec- tion therewith; and WHEREAS, said Commission, after due inspection, investigetion, and study made by itself ead in its behalf, end after dae consideretion of ell evidence and repoRs offered at seid heering, does find and determine the following facts: 1. That the petitioner requests a variance from the Anaheim Municipel Code: to permit the division of two existing lots into four parcels as follows: SECTION 18,24,030(4~•a) - PAinimum lot width (70 feet required; 50 feet, 67 feet and 54 feet respectively proposed on 3 of the 4 lots). SECTION 18,24.030(4-a) - Minimum lot area (7200 square feet required; one iot containina 5770 square feet, and one lot containing 6231 sGuare feet proposed). 2. That there are exceptional or extraordinary circumstences or conditions applicable to the property involved or to the intended use of the property that do not apply generelly to the property or cless of use in the same vicinity and zone. 3. That the requested veriance is necessary for the preservation end enjoymmt of a substential property right possessed by other property in the seme vicinity and zone, and denied to the property in question. 4. That the requested variance will not be meterially detrimentel to the public welfete or injurious to the pmFa erty or improvements in such vicinity and zone in which the property is located. 5. That the r~quested waivers vaould permit the properties in ouestion to develop with lots ~riidths and lot areas comparable to the existi~g lots in this orea. 6. That no one aopeared in ooposition to subject petiti.on. Vl-G -1- ~/x NOW, THEREFORE, BE IT RESOLVED ffiat the Anehelm City Plenning Commission does hereby grant subject PeUtion for Veriance, upon the following conditIons which ere hereby found to be a necessary prerequisite to the pro- posed use of the subject property in otder to preserve the aefety and generel welfare of the Citizens of the City of Aneheim: 1. That this variance is granted subject to the completion of Reclassification 1Jo. 67-68-4. 2. That the sidewalks shall be instailed along Cherry Way, as required by the City ~ngineer and in accordance with standard plans and specifications on file in the office of the City Engineer, prior to final building inspection. 3. That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the Building Permit is issued. 4.
