PC 67-185RESOLUTION NO PC67-lh5 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ANAHEIIM THAT PETITION FOR RECLASSIFIChTION N0. 67-6~?-10 BE APPROVED WHEREAS, the City Planning Commiaaion of the City of Anaheim did recelve e rerified Petition for Reclaseifica- tionfrom NORBERT Ta AND DORA ANN EIMERS9 AND h1ARGARET C~ SHINN, 628 ~9est Valley View Drive, Fullerton, California 92b32, Owners; MESA LAND CJMPANY, 12n £ast Katella, Orange, California, Agent of certain r?al property situated in the City of Anaheim, County of Orange, State of California, described as Parcel 1: The east one-half of the south one-half of the Northeast quarter of the Northeast quarter of Section 13, Township 4 South, Range 11 Ple=t, being in the Rancho Los Coyotes, a= shown on a ~9ap thereof recorded in book 51, paae 7, et seq., ~discellanew= hlap=_, records o; said Orange County ; and WHEREAS, the City Plenning Commission did hold a public hearing et the City Hall in the City of Anaheim on August 14, 1967, a~ z;pp o'clock P.M. notice of seid public henrine havin~ been duly given es required by l~a and in acrnrdence with the provisio-a of the Maheim Municipal Code, Chapter 18.72, to hear and consider evidence fin end against seid proposed reclessification end to investigate and ma{ce findings and recommendations in connection therewith; and WHEREAS, seid Commission, aher due inspection, investigation, and study made by itself end in its behalf, and efter due consideration of all evidence and reports offered at seid hearing, does find and determine the following facts: 1. That the petitioner proposes a reclassification of the above described property from the R-A, Agricultural , Zone to the R-3, h;ultip!e Family Residential, Zone to establish a 120-unit tivo-story apartmer.t development on subject property. 2. That the madium density zoning would 'oe compatible with the existing land use=_ and zoning in this general area. 3. T}~at tne scope o: the proposed reclassi:ication, i: approved, ooes not warrant ~n amendment to the General Plan at the present time, however, its relationship to the Genera'. P'an symboi will be considered at the next annuai review. G. Thet the proposed reclsssitication of subject property is necessary and/or desiroble tor the orderly and pro- per developnsent of the community. 5. That the proposed reclessificetion of aubject property does properly relate to the zones and their permitted uses locelly established in close proximity to subject property and to the zones and their permitted uses gmerally estab- lished throughout the rnmmunity. o. That the proposed reclassification of ~~ibject property requires the dedication and imorovement of abutting streets in accordance with the Circulation Elemert of the General Plan. due to the anticipated increase in traf`ic which will be generated by the intensi.`ication of land use. ?. Tnat one letter was received in opposition to subject petition. ~ x R-A -1- S ~ ~ NC~W, THEREFORE, SE IT RESOLVED that the Aneheim City Plenning Commission does hereby recommend to the City Council of the City of Anaheim that subject Petition for Reclesaification be epproved end, by so doing, thet Title 1&Zoning of the Aneheim Municipal Code be amended to exclude the above described property Erom the R•A, Agriculturai, Zone and to incorporate said described property into the R-3, Multiple Family Residential, Zone upon the °ollowing conditions which are hereby iound to be a necessary prp- requisite to the prooosed use of subject property in order to preserve the safety and generai welfare of the citizens of the City of Anaheim. 1. That the owners of subject property shall deed to the City of Anaheim a strip of lznd 53 f'eet in width from the center line of the street along N~agnolia Avenue, for street widening purpos es . 2. That street improvement plans shall be prepared and all engineering requirements of the City of Anaheim along hlaynolia Avenue, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other aoourtenant work shall be completed as renuired by the City Engineer and in accordancc with standard plans and spe:ifications on file in the office of the City Engineer; and that a bond in an amount and form s~tisfactory to the City of Anaheim i~~ shall be posted witn tne City to guarantee the installation o: said engineering requirements. ;€ 3. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 ~f per front foot along Magnolia Avenue, ior street lighting purposes. i' i 4. That the owners of sub_;ect property shall pay to the City of Anaheim the sum of 15¢ per ;ront foot along Magnolia Avenue, for tree planting purposes. , 5. Tnat the owners of subject property shall pay to the City of Araheim the sum of ~25.00 , per dwelling unit, to be used for oark and recreation ourposes, said amount to be paid zt the ~ time the building permit i= issued. j ' 6. That drainage sha ll be discharged in a manner which is to tne satisfaction of the City ~ Engineer. i 7. That all utility lines <hall be placed underground. The Utilities Director may waive the requirement if topographical, soil, or other conditions make such underaround instrilation I impractical. I ~ ~.
