PC 67-41RESOLUTION NO PC67-41 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT °21 BE GRANTED WHEREAS, the City Planning Commissiou of the City of Maheim did receive e verified Petition for Conditionel Use Permit from EUCLID S}',OPPING CENTER, 1660 West Katella, Anaheim, California, Attn: JOHD! ~X, Osvners of certain real property situat~d in the City of Anaheim, County of Oranqe, State o: California, described as Lot 3 of Tovms2nd's Subdivision, as shown on a map thereof recorded _ in book 5, page 40, A9iscellaneous hlaps, records o: said Orange County. EkCEPTI'~!G FROhS said ~~ Lot 3, the West 2C? feet o: the North 210 feet thereof, measured to tne center ]ina of streets ; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on Februdry 27, 1967 at 2:00 o'clock P.M., notice of seid public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal code, Chepter 18.64, to hear end consider evidence for and against said proposed conditional use and to investigate and meke findings and recommendetions in connection therewith; and WHEREAS, said Commission, after due inspection, investigetion, and study made by itself and in its behalf, and after due consideretion of all evidence and reports offered at seid hearing, does find and determine the following fects: I. That the proposed use is properly one for which a Conditional .Use Permit is authorized by this Code, to wit: $ection 1R.40.060(h) to establish a n;ant nursery in conjunction with an exist:na shoopina center. 2. That the propos;:d use will not adversely affect the adjoining land usrs and the growth end development of the area in which it is propose8 to be located. 3. That the size and shape of the site proposed for the use is adequate to allow the full development ofthe pioposed use in a manner not detrimenta! to the particular aree nor to the peace, health, sefety, and general welEere of the Citizens of the City oE Anaheim. 4. That the granting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimentel to the peace, health, sefety, and general welEare of the Citizens of the City of Anaheim. 5. That the oetitioner stioulated to tne construction of a fence or ~vall ~o enclose t^~ disolay of plant area. 6. That no one apaeared in opposition to subject oetitior.. Ci-G _1_ ~x S r, NOW, THEREFORE, BE IT RESOLVED thet the An~heim City Planning Commisrion does hereby grent subject Petltion for Conditionel Use Petmit, upon the followIng condltiona which are hereby found to be a neeessery prerequisite to the proposed use of the subject property in order to preaerve the aefety and generel welfare of the Citizens of the City ot Aneheim: 1. That subject property shall be developed substantially in accordance with olans and specifications on file with the City of Anaheim, marked Exhibit iJos. 1, 2, and 3, provided, however, that a 5-foot fence or wall shall be constructed so as to enclose the plant area ; proposed, as stipulated by the petitioner, and that all parking sha11 be in conformance with code requirements. 2.
