Chapter 1R,dR, to hear and consider evidence for and against said proposed ~.ariance and to investigate and mahe findings end recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation. and study made by itself and in its beha?f, and after due consideration of all evidence and reoorts of:°ered at s~id heariny, does find and determine the followin9 :zcts: :, That the petiiioner requests variances from the Anaheim Municipal Code to oernit deveiopment of a 64-unit two-story apartment development as follolvs: SECTION iR.2R.050(5-b) - Mar.imum permitted building heiyht, (1-story plus roo: structure within 150 feet of R-A Zone permitted; 2-stories plus roof structure proposed)~ SECI'IOiJ 1R,2R,050(6-•a-4)•- Ya:ds and buildina setbacks. (Building setback of 15 ;eet required; setbacks of 9 and 12 feet proposed). SECTION 1R,2R,050(11Z - P~alls. A 6-:'oot solid masonry wall is required along the property line abutting the R-A Zone on the east and a portion of the west; no walls proposed. 2. That the siz? and shape of the parcel is adequate to provide :or yards and building setbacks reouired by the R-3 Zone, and therefore, the waiver of Section 1R.2R,050 (6-a-4) is d•-nied on the basis that no hardship was proven to warrant said waiver. 3. That the req~ested waivers relating to building height and walls are warranted. since thi= general area is designated on the General Plan for medium de~sity resideitia] dtvelo~ment. 4. That there are exceptional or extraordinary circumstan~es or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 5. That the requested variance is necessary for the preserv2tion and en~ioyment of a substantial property right possesszd by other property in the same vicinity and zone, and denied to the prooerty in question. 6. That the reque=_ted variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 7. That no one appeared in oppos~tion to subject oetition. ~- . - .;. - - --- ~ NOW, THEREFORE, BE IT RESOLVED thot the Aneheim City Planning Commission does hereby grant subject Petition for Varianr:e, upon the following conditions which are hereby found to be e necessary prerequisite to the pro- posed use of the :subject property in order to preserve the sefety end general welfare of the Citizens of the City of Anaheim. 1. That a Final Tract Map of subject property be approved by the City Council and recorded in the office of the Orange County Recorder. 2. That thi= Variance is yranted subject to the completion of Reclassification No. 66-67-56. 3.
