PC68-119 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM ; THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1023 gE GRANTED i WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Conditional Use Permitfrom W~STERN L. ~RPORATION, 315 South Broadway, Los Angeles, California 90013, Owner; LETTY WIDEBURG, 620 West La Palma Avenue, Anaheim, California 92801, Agent of certain real property ;ituated in the City of Anaheim, County of Orange, State of California, described as Parcel 3 and 4 of that portion of Lot 40 of Anaheim Extension, as per map filed in Boo}: 48, :*~ . ;. page 50 of Record of Surveys, in the office of the County Recorder of said Orange Cour.ty ; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the Cit}~ of Anaheim on May 6, 1968, at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal code, Chapter 18.64, to hear and consider evidence for and agair.st said proposed conditional usa and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, aftet due inspection, investigation, and study made by itself and in its behalf, and after due consideration of all evidence and reports oftered at said hearing, does find and det<_rmine the follo wing facts: 1. That the proposed use is properly one for which a Conditional Use Permit is authorized by Code: Section 18.40.060(g) to wit: permit on-sale beer and wine in an existing delicatessen. 2. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be loceted. 3. That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 4. Tfiat the gtanting of the Conditional Use Pertnit under the conditions imposed, if nny, will not be detrimental to the peace, health, safety, and general welfare of the Citizens of the City of Aneheim. 5. That the petitioner stipulated that the beer and wine would be served only along with meals and would be incidental thereto. Cl-G _ 1. ~ ~ ~ ~ : ","et.. ~._.. ~ ~ ~ _r . - ) NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Pe~pn fot Conditionel Use Permit, upon the following conditions which ere hereby found to be a necessary prerequisite to tfi~ proposed use of the subject property in order to preserve the safety and general welfere of the Citizens of the City r! Anaheim: 1. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public 'Norks. 2. That any air-conditioning facilities proposed shall be properly shielded from vie,~. 3. That Condition Nos. 1 and 2, above mentioned, shall be complied with prior to final building and zoning inspections. 4. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit Nos. 1, 2, and 3. '~ ' 5.
