! ~ WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on
F I January 3, 196R, at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by
~ law and in accordence with the provisions of the Anaheim Municipal code, Chapter 18.64, to hear and consider evidence
',~ for and against said proposed conditionel use and to investigate and meke findings and recommendations in connection
'I therewith; and
~ WHEREAS, said Commission, after due inspection, investigetion, and study made by itself and in its behalf, and
aEter due consideration of all evidence and reports ofEered at said hearing, does find and determine the following facts:
1. That the proposed use is properly one for which a Conditional.Use Permit is authorized by Co;e S~;;tior,
i~.64.020(5) to wit: stockpile topsoi: and storaae of equioment necessary :o: the loadiny ar.d
hauiing of the topsoil on subject oroperty.
2. That the proposed use will not adversely aEfect the adjoining land uses end the gzow:h tind development of
the area in whi-h it is proposed to be located.
3. That the size and shape of the site proposed for the use is adequate to allow the full development of the
- pzoposed use in a manner not detrimentai to the particular area nor to the peace, health, safety, and generc+l welfare
- ofthe Citizens ofthe City of Anaheim.
4. That the granting of the Conditiona] Use Permit under the conditions imposed, if any, will not be detrimental
to the peace, health, safety, and genera( welfare of Uie Citizens of the City of Anaheim.
5~ That the oetitioner stipuiated that only seven (7i pieces of equipment would be stored
on subject property - both equipment for loadiny, mixing and hauling of tonsoil9 and that he
did not intend to sto:e more than 1000 yards of toosoii on the prooerty at any time.
6o ThattJ;o persons aopeared in ooposition9 one representing a major industriai comolex
to the south of subject property.

~ le That the pzoposed use is granted for a period of one (1) year, a;'ter which time
subject petition shali be set for public hearinq to determine whether the use has been
; objectionable and has become a nuisance, in order 'that consideratior. may be given io an
extension for an additional period of time.
2o That a maximum of seven (7) pieces of equipment9 including trucks and equipment for
loading and haulir,g of the topsoil shall be permitted to be stored on subject property, as
stipulated by the petitioner~
~ 3. That a maximum of 1000 yards of topsoii shail be stored at any one time9 and said
j;';: topsoil shall be wetted down to controi the amount of dust which may b? ger.ex•ated into the
'i:;, area, as stipulated by the petitfoner.
