RESOLUTION N0, p~68-121 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 19~5 _ gE GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from GODFREY L. GOGERTY, 243 South Walnut Street, Newport Beach, California 92660, Owner; RONNIE H. ' f ` `'i1 I ~ ~``l~ -ti , , •~i` J !~ t _ ` ~~`~~ ~ -`r~, ; and NHEREAS, the City Planning Commission did hold e public hearing at the City Hall in the City of Anaheim on hiay 6~ 1968~ at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.68,to hear and consider evidence for and dgainst said proposed variance and to investigate and make findings and recommendations in connec- tion therewith; and {VHEREAS, said Commissinn, after due inspection, investigation, and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the foliowing facts: 1. That the petitioner requests a variance from the Anaheim Municipal Code as follows, to permit the expansion af an existing, non-conforming use to construct a new automobile showroom: SECTION 18.44.J:0 - Permitted uses in the C-~ Zon~. That there are exceptional or extraordinary circumstences or conditions app(icable to the property involved or to the intended use of the property that do not apply generally to the prope:!y or class of use in the same vicinity and zone. 3. That the requested variance is necessary for the preservation and enjoyment of a substential property right possessed by other property in the seme vicinity and zone, and denied to the property in question. 4. That the requested variance will not be materially detrimental to the public welEare or injurious to the prop- erty or improvements in such vicinity and zone in which the property is located. 5. That subject property has been in use as an automobile sales facility for approximately 20 years, as have a number of other parcels in this area, and that new construction along Anaheim Boulevard can do nothing but improve the general apoea:ance of subject prooerty and the area as a whole. 1 ,,- k~ 4 ~'~ ~ ~ I _ ~ ~ i , :\I ~ NOW, THEREFORE, BE IT RESOLVED that tke Anaheim City Plenaing Commissioa does hereby grent subject Petltion for Varience, upon the followIn` conditions which are hereby fowd to be a neceseary prerequisite to the pro- posed use of the subject prope:ty ln order to preserve the safety and general welfare oE the Citizens of the City of Anaheim: 1. That the owner of subject property shall pay to the City of Anaheim the sum of 15~ per front foot along Anaheim Boulevard, for tree planting purposes. 2. ihat trash storage areas shall be provided in accordance with approved plans on file , with the office of the Director of Public Works. 3. That any air-conditionina facilities proposed shall be properly shielded from view and the sound shall be buffered from adjacent residential homes. 4. That all exterior lighting shall be directed downward and away from abutting property lines. 5. That Condition No. 1, above mentioned, shall be complied with prior to tne time that the Building Permit is issued or within a period of 180 days from date hereof, whichever occurs first, or uch further time as the Commission or City Council may grant. 6. That an amount of landscaping equivalent to~the normally required 3-foot planter strip adjacent to the Anaheim Boulevard right-•of-way plus 2~ of the interior parking area shall be provided in some manner on the site, which landscaping shall be subject to the approval of the Development Services Department. 7. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marhed £xhibit Nos. 1, 2, and 3, provided that all structures, including roof overhangs, shall be a minimum of 40 f eet from the centerline of : Anaheim Boulevard, and further provided that subject property shall be landscaped in accordance with Condition No. 6 above. 8, That Condition Nos. 2, 3, 4, and 6, above mentioned, shall be comolied with prior to ' final building and zoning inspections. ?H~ FORECiO~iCi 1tBMiLiT'319if ts il~od asd ~pp~v~ed by ~ this , 16th day of May, 1968. ./`, .
