PC 68-133RESOLUTION N0. p~o8-133 A RESOLUTION OF THE CITY PLANNlNG COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 198?_ BE DENIED WHEREAS, the City Plenning Commission of the City of Anaheim did receive a verified Petiti~n for Variance from TEXACO, INCORPORATED, P. 0. Box 817, Wilmington, California 90744, Owner; W. B. USARY, 100 South Brookhurst Street, Anaheim, Cali•:ornia 92804, ", ent of certain real pro erty situated in the City of Anaheim, County of Orange, State of Californ~ia, described as the SouPh 150.00 feet of the North 216 f eet of the West 190 f eet of Lot 4 in Block A in Tract blo. 13, as per map recorded in book 9, oage 12, Miscellaneous Maps, said North and West distances being m easured to the centerlines of the streets adjoining said lot on the North and West. FJ{CEPT that oortion thereof described as ~~1~ follows: Beginning at a point on the Dlortherly line of said land Easterly 60 feet :rom the IJorth- ,i west corner thereof; thence Westerly along said p~_allel line to s~id Northwest corner; therrce Southerly along said West line to a line oarallel with and Southerly 20 feet from said 'dorth line; ~~ ' thence Easterly 40 feet along said North ~line; thenca Northeasterly on a direct line to the point ~ ;S of beginning i 1 ~ I. ; and WHEREAS, the City Planning Commission did hold a public hearing et the City Hell in the City of Anaheim on May 20, 1968, at 2:00 o'clock P.M11., notice of said public hearin havin been dul law and in accordence with the provisions of the Anaheim Municipal Code, Chapter 18,68, to hear and cons der evedence for and against said proposed varience and to investigate and make findings and recommendations in connection iAerewith; and R'HEREAS, seid Commission, after due inspection, investigetion, end study made by itself end in its behalf, and efter due consideration of all evidence and reports offered at said hearing, does find and detertnine the following fact~: 1. That the petitioner requests a variance from the Aneheim Municipal Code as follotv,, in order to permit the outdonr storaoe of rental trucks on subject propert~~: SECTI0~1 18.08.330 (Par. 5) - Def~~ition of automobile service station. (Included rrithin the definition of automobile service s+ation i= ±~;., ~±z~~T~~+ that "all painting, body and fender repair, tire recapping, and the rental of other heavy equipmeni, and the sale and rental of other merchandise other than specified above is excluded"; petitioner proposes to store and rent heavy equip- ment that is not included in the list o:° permitted uses :or service stations}. SECTION 18.40,040 - Outdoor uses. (The outdoor storage of rental equioment is not a oermitted use in the C-1 Zone). 2. That there are no exceotional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not aoply generally to the p~•operty or class of use in the same vicinity and zone. 3. That the requested variance is not necessary for the preservation and enjoyment o; a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in q~iestion. 4. That the requested variance ~vill be materially detrimental to the public ~rrelf~re or injurious to the prope*ty or improvements in such vicinity and zone in which the property is located. 5. That no evidence was presented that indicated that the provisions of the Anaheim PA~icipal Code tivere deterring the eff ecient use of subject p:operty, nor was there any demonstration that a hards.iip exists that would justify approval of the requested waivers. 6. That the staff was directed to study the feasibility of amending the service station standards to inciude the storage of trucks in addition to trailers, ti•rith a certain maximum number of pieces of equipment being permitted depending upon the size of the parcel and the location. 7. That one person apoeared in opoosition.
