PC58~15 A RESOL~JTION OF THE CITY PLANNING COMAiISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT NO. 996 gE GRANTED WHEREAS, [he City Planning Commission of the City oE Anaheim did receive a verified Petition for Conditional Use Permitfrom VILLA ENTERPRISES, INCORPORATED, 1405 East Chapman, Orange, California 92667, Owner; ANN MADISO(V9 600 South Harbor Boulevard, Anaheim, California 92R05, Agent of certain real property situated in the City of Anaheim, County of Orange, Stait of California, described in Exhibit "A" attached hereto and referred to herein as though set forth in full ; and WHEREAS, the City Planning Commission did hold a public heazing at the City Hall in the City of Anaheim on January 15, 1968 at 2:00 o'clack P.M., notice of said public hearing having been duly given as required by lew end in accordence with the pro~•isions of the Anaheim hlunicipel code, Chapter 18.64, to hear and consider evidence for and egair.st said proposed conditiona! use and to investigate and m ake findings and recomm endations in connection - therewith; end ~ '~. -_ WHEREAS, said Commission, after due inspection, investigation, and study made by itself end in its behalf, and efter due consideretion of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the roposed use is properly one for which a Conditiunai Use Pennit is authorized by COd=: Section I8,64.020~1-f) to wit: establish a day school in an existing residence for kindergarten through sixth grade on s~bject property. 2. That the proposed use will not adversely alfect the adjoining lend uses and the growth and develapment oE the aree in which it is proposed to be located. 3. That the size and shape of the site proposed for the use is adequate to a)low the full development of the proposed use in e mennec not detrimental to the particular area nor to the peace, heelth, safety, and general welfare of the Citizens of the City of Anaheim. 4. That the granting ot the Conditional Use Peimit under the conditions imposed, if any, wi11 not be detrimental to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 5. That due to the fact that other properties immediately adjacent to subject proPerty ` have not improved their properties with sidewalks, the Commission deems it appropriate that the t City Council give consideration to waiving installation of sidewalks for a period of one year. 6. That a circular drive should be developed at the front of subject property, in order to provide more =fficient circulation for drop-off and pick-up traffic, since present driveway and parking facilities are not adequate for this purpose~ ~ 7. That since the parcels on both sides of subject property are used for residential ;~ purposes, and the proposed use is of a commercial character, a masonry wall should be provided in order to insure th~ residents in the area adequate protection from the day school use. R, That the Stat~ of California has certain requirements which would limit the number of "s students that may be enrolled at the school, based upon minimum area per student within class- rooms and minimur~ outdoor recreation area per student. That the owner of subject prouerty shall pay to the City of Anaheim the sum of $2.00 per front foot along Vermont Avenue, for street lighting purposes. 2. That trash storage areas shall be provided in accordance with approved olans on file ~vith the office of the Director of Public Works. 3. That any air-conditioning facilities proposed shall be properly shielded from view, and the sound shall be buffered From adjacent residential homes. 4. That a six•-foot (6) masonry wall shall be constructed along the east and west oroperty lines. 5. That a circular drive shall be provided in the front setback area. 6. That Condition yos~ 1, <^, 3, 4, and 5, above mentioned, shall be complied with prior to the time that subject property may be occup~ed and used as a~ay school. 7. That an inspection shall be made of the premises by representatives of the City of Anaheim to determine the current status of all structures on subject property and how they conform to the minimum standards of the liniform Building, Hlectrical, and Plumbing Codes, as adopted by the City of Anaheim, and to all fire sa.`ety regulations of the City of Anaheim. A11 de`iciencies noted in this insoection shall be corrected and all structures on subject property shall be brought up to the minimum standards of the Uniform Buildinq, Electrical, and Plumbing Codes, as adoFted by the City o: Anaheim, and all fire safety reaulations o: the City of Anaheim prior to the time that subject orocerty may be occupied arad used as a day school. 8. That subject oroperty shall be developed substantially in accordance with olans and specifications on ;ile with the City of Anaheim as amended by the above conditions.
