P~68-152 ' A RESOLUTION OF THE CITY PLANNn:G COMMISSION OF THE CITY OF ANAHEIM RECOMMENDING TO THE CITY COUNCIL OF THE CtTY OF ANAHEIM THAT PETITION FOR RECLASSIFICATION N0. 67`68-88 gE APPROVED WHEREAS, the City Plenning Commission of the City of Aneheim did recelve a verified Petition for Reclassifica- tion from E.. T. HILLMAN, ~'!' AL, 2610 West Ball Road, Anaheim, California 92804, Owner; WESTERN SHOPPING C~TERS, INCORPORATED, 811 West 7th Street, Los Angeles9 California 90017, Agent of certain real property situated in the City of Anaheim, County of Orange, State of Caiifornia, ? described in Exhibit "A" attached hereto and referred to herein as though set forth in full :s 'ir'~ ~G ; and WHEREAS, the City Planning ComRissiort did hold a public hearing et the City Hall in the City ot Anaheim on June 3~ 19b8 at 2:00 o'clock P.M. notice of said public hearing heving beea duly given es required by law and in accordance with the provisions of the Aaaheim Atunicipal Code, Chepter 1R.72, to hesr end consider evidence for and against said proposed reclassificetion end to investigate artd make findings end recommendations in connection therewith; end WHEREAS, said Commission, after due inspection, investigation, and study mede by itself end in its behalf, and efter due consideretion of all evidence end reports offered et said hearing, does find and determine the Eallowing fects: 1. That the petitioner proposes a reelassification of the above described property from the R-A, Agricultural, ; Zone to the G1, General Commercial, Zone. 2• That the scope of the proposed reclassification, if approved, does not warrant an amendm.ent to the General Plan at the present time, however, its relationshio to the General Plan symbol will be considered at the next annua! review. ~ ~ 3. That the proposed reclessification of subject property is necessery end/or desirable for the orderly end pro- per developnrent of the community. 4. That the proposed reclessificetion of subject property does properly relate to the zones and their permitted uses locelly established in close proximity to subject property and to the zones end their permitted uses generally estab- lished throughout the community. 5. That the proposed x,.classification of subject ~:operty requires the dedication and improvement of abutting streets in accordance with the Circulation Element of the General P1an, due to the anticipated increase in traffic which will be generated by the intensification of land us e. 6. That the petitioner stipulated to providing trees in treewells at 20-foot intervals to provide screen landscaping along the west and so>>th property lines of subj~ct property; and that any signing proposed would comply with the C-1 Zone sign regulations. ' . _ :. . _.~`~~ ~~ _~~ ,..... ,.., . ~ S •'~ ~NaW~ THEREFORE, BE IT SOLVED th~t W~ An~h~im C1tq plann~ ~~Ammiuioa doea hereby recommend to the City Council of th~ City of Miheim th~t ~ubj~cf Petltian foe gscl~jgG~ ~~ro~~ ond, by so doing, that Title 1&ZoninQ of the Ae~he;m IVlun;cip~l Cod~ b~ ~-;~d~d ~ t~~ ~~ ~v~ dacribed property from the R-A, Agricultural Zone, and to incorporate said described property into the C-1, General Commercial, Zone, upon the following cunditions which are hereby found to be a necessary pre- requisite to the proposed use of subje~t property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim. 1• ihat the owner of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the centerline of the street, along Ball Road and Magnolia Nvenue, for street widening purposes. 2. That street improvement plans shall be prepared and all engineering requirements of the City of Anaheim along Ball Road and Magnolia Avenue, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be completed as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; and that a bond in an amount and form satisfactory to the City of Anaheim shali be posted with the City to guarantee the installation of said engineering requirements. 3. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Ball Road and Magnolia Ave~ue for street lighting purposes. 4. That the owner of subject property shall pay to the City of Anaheim the sum of 15¢ oer front foot along Ball Road and M~gnolia Avenue, for tree planting purposes. 5. That ~ondition Nos. 1, 2, 3, and 4, above mentioned, shall be complied with rJit',in a period of 180 days from the date hereof, or such further time as the City Council may grant. 6. That any proposed air-conditioning facilities and/or refrigeration equioment shall be properly shield ed :rom view, and the sound shall be buffered from the udjacent residential homes to the south. 8.
