A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCF N0. 1990 BE GRANTED WFiEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from DAVID DOW, 1160 South Street, Lono Beach, California 90805, Owner; FIRESTONE TIRE A;dD 9BER COMPANY, 2525 Firestone Boulevard, Los Angeies, California 90054, Ag~nt of certain real property situated in the City of Anaheim, County of Orang e, State of California, described as Parcel 1: The east 90.00 f eet of the South 125.00 fe?t of of the North 161.00 feet of lot 3 in block A of Tract ;~o. 13, as per map recorded in book 9, page 12 of Miscellaneous Maps, in the office of ! the County Recorder of said county ; and WHEREAS, the City Planning Commission did hola a public hearing at the City Hall in the City of Anaheim on June 17, 1968, at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidence for and against said proposed variance and to investigate end make findings and recommendations in connec- tion therewith; and ;s~ ~~ -f ; . ~ Vl-G ~ fi _~ ~ WHEREAS, said Commissinn, after due inspection, investigation, end study mede by itself and in its behelf, and aEter due consideration of all evidence and reports offered at said hearing, does find and determine the foliowing facts: 1. That the petitioner requests e va~iance E:cm the Aneheim Municipal Code as follows, to permit the establisfr ment of a retail tire, battery a d accessory store on subject property: SECTION 18.40.020 - Permitt d .(The type of use that is proposed for sUbject prope*ty ~s not a use that is permitted in the C-1 Zor~e, but is one that would be permitted as a matter of right in the C-2 or C-3 Zones). 2. That there are exceptional or extraordinary circumstances or conditions appliceble to the property involved or to the intended use ~f the property that do not apply generally to the property or cless oE use in the seme vicinity and zone. 3. That the requested varience is necessary for the preservation and enjnyment of a substantial preperty right possessed by other property in the seme vicinity and zone, end denied to the prnperty in question. 4. That the requested variance will not be meterially detrimental to the public welfare or injurious to the prop- erty or improvements in such vicinity and zone in which the property is located. 5. NOW, THEREFORE, BE IT RESOLVED thet the nnaheim City Planning Commission does hereby gra.t sub~ect - Petition for Veriance, upon the following conditlons which ate hereby found to be e necessary prerequiciie to the ~oro- 4 posed use of the subject pcoperty in order to presetve the sefety and generel welfare of the Citizens of the Cit~~ of r' Aneheim: ~ 1, That street improvement plans shall be prepared and all engineering requiremeni,s of the ~ City of Anaheim alonq Lincoln Avenue, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant wo~k shall be completed as required by the City Engineer and in ac;cordance with standard plans and specifications on file in the office of the City Engineer; and that a bond in amount and form satisfactory to the City of Anaheim shail be , posted with the Gity to guarantee the installation of said engineering requirements. ?. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Lincoln Avenue, for street lighting pur oses. 3. That the owner of subject property shall pay topthe City of Anaheim the sum of 15~ per ~ front foot along Lincoln Avenue, for tree planting purposes. 4. That Condition Nos. 1, ?_, and 3, abovE mentioned, shall be complied with prior to the ,F~;~ time that the Building Permit is issued or within a period of 180 days from date hereof, which- z,t°:: ever occurs first, or such further time as the Commission or City Council may grant. ~ ,;,r 4.,~t 5. That a Parcel Map to record the approved division of s~bject property be submitted to R^r£ the City of Anaheim for approval and then be recorded in the office of the Orange County Recarder, ~?r= prior to final building and zoning inspections. :ti 6. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. ,'~ 7. That any air-conditioning facilities proposed shall be properly shielded from view. ,.~ 8. That all exterior lighting shall be directed downward and away from adjacent ;;~ parcels. ,~ 9. That Condition Nos. 5, 6, 7, and 8, above mentioned, shall be complied with prior to ;~ final building and zoning inspections. ~ 10, That subject property shall be deve~oped substantially in accordance with plans and ~ specifications on file with the C<ty of Ar~~heire, m~~r;ed "c'xhibit Nos. 1 and 2.
