THAT PETITION FOR VARIANCE N0. 1992 gE F1i~~ f~ViD WHEREAS, the City Plenning Commission of the City of Anaheim did receive a verified Petition for Veriance from WILLIP.M M. ROESCHLAUB, P.O. Box 4124, Anaheim, California 92803, Owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as Lot tJ~. 8, Block A of Tract No. 237 ~~rt { :~. ~ i .:-iJ ~ i;~ J 8na '' WHEREAS, the City Planning Commis!:i.vn did h¢ld a public hearing at the City Hall in the City of Anaheim on '~' June 17, 1968, at 2:00 o'clock P.M., notice o'f said public heering heving been duly given as required by `~~ law and in accordance with the provisions of the Ane~eim Afunicipal Code, Chapter 18.68, to hear and consider evidence for and against said proposed variance and tn investigate end make Eindings end recommendotions in connection therewith; and 1VHEREAS, said Commission, after due inspection, investigation, end study mede by itself and in its behalf, and after due consideretion of all evidence and reports offeredat said hearing, does find and determine the following * facts: i 1. That the petitioner requests a variance from the Anaheim Municipal Code as follovas, in order to permit ; the construction of a two-story, two-unit apartment building on subject property: SECTION 18.28.050(5-b) - Maximum buildin4 and structural heiaht limitations. (One-story _ construction permitted within 150 feet of any single-family residential zone; two-story construction proposed within 22 :eet of the R-1 Zone). ~; ~ SEG7ION 18.28.050(10-c)- Minimum size for covered oarkinca spaces. (10-foot widths req- - quired; approximately 9.7 foot wide stalls proposed). 2. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 3. That the requested variance is necessary for the preservation and enjoyment of a :~ substantial property right possessed by other property in the same vicinity and zone, and denied ;i to the property in question. ~~'' 4. That the requested variance will not be materially detrimental to the public welfare ~ or injurious to the property or improvements in such vicinity and zone in which the property is located. ~ 5. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 ~ per dwelling unit to be used for park and recreation purposes, said amount to be paid at the ~ time the Building Permit is issued. ~ 2. Tha~ the owner of subject property shall deed to the City of Anaheim a strip of land ~ two (2) feet in width alonq the westerly property line of the subject property for alley widen- ~ :ng purposes. ~ 3. That the vehicular access rights to Lamon Street shall be dedicated to the City of ~ Anaheim with a tem orar ~ p y permit being granted for the ezisting driveway. 4. That trash storage areas shall be provided in accordance with approved plans on file ~% with the office of the Director of Public Works. '~ ~ 5. That Condition Nos. 2 and 3, above mentioned, shall be com lied with p prior to the time ~ -~ ,~ that the Building Permit is issued or within a period of 180 days from date hereof, whichever occurs first, or such further time as the.Commission or City Council may grant. 6. That subject property shall ba developed substantially in accordance with plans a~d ;,~ specifications on file with the City of Anaheim, marked Exhibit No. 1.
