PC68-181 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 1991 gg AP^ROVED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from MILTON WINTROB, 1527 Chateau Avenue, Anaheim, California 92802, (hvner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as Lot No. 20 of Tract No. 3310 ,~~ ;~-~V ~ . ~~ , • ~~ ~'t ~% ~;~ _ ~; i * , „/~ i ; and WHEREAS, the City Planning Commission did hold a public hearing at the City HaII in the City of Anaheim on June 17, 1968, at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by !aw and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidence for and against said proposed variance and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf, and after due consideration of all evidence and reports offeredat said hearing, does find an~' determine the following facts: 1. That the petitioner requests a variance from tSe Anaheim Municipal Code as follows, to permit an addition to an existing single-family residence: SECTION 18.24.030(3-b) - Minimum reouired rear ard setback. (A minimum of 10 feet re- quired; 6 feet proposed .(The Code further provides that additions to existing dwellings may be permitted to extend into tFe required rear yard area no closer than 10 feet to the rear lot line, provided that an equal area of outdoor living space is provi.ded elsewhere on the lot. The petitioner is unable to provide an equal area elsewhere on the lot). 2. That there are exceptional or P~•traordinary circumstances or conditions applicable to ~he property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 3. That the requested variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 4. That the requested variance will not be materialiy detrimental to the public welfare or injurious to the property or improvements ~n such vicinity and zone in which the property is located.
