A RESOLUTiON OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 1993 BE GRANTED WHEREAS, the City Plenning Commission of the City of Anaheim did receive e verified Petition for Verience from ALVIN F. NELLESEN, 1173 Cherry Way, Anaheim, California 92801, Owner of certain real prop.erty situated in the City of Anaheim, County of Orange, State of California, described as the South 120.00 feet of the North 370.00 feet of the West 130.00 feet of Lot 5, as shown on Record of Survey of a part of section 4, Township 4 South, Range 10 West, S.B,M., in the Rancho San Juan Cajon de Santa Ana, filed in book 1 page 55 of Record or Surveys of said county. ; end . i I ~ ;; ~ r? ~ i;f I ~` ~ .1F 1 ~~ ~ :~ .~ =« . ,, ~ ~1~ ~ ~ ,{ ~ t ~ ~ ~ Wi;EREAS, the City Plenning Commission did hold a public hearing et the City Hall in the City of Anaheim on June 17, 1968, at 2:00 o'clock P.M., notice of seid public hearing heving been duly given as required by law and in eccordar.ce with the pcovisions of the Anaheim Municipal Code, Chapter 18.68,to hear and consider evidence for and egein~t said proposed variance and to investigate and meke findings and recommendations in connec- tion therewith; and WHEREAS, seid ~:' nmission, after due inspection, investigation, and study made by itself end in its behalE, and after due considers ~n of all evidenc^ and reports offeredat said hearing, does find and determine the following fects: 1. That the petitioner requests e veriance from the Anaheim Municipel Code as follows~ in order to permit a lot split of an existing R-1, One Family Residential, Zone parcel: SEGTION 18.24.030(4-a) - Minimum required lot width and lot area. (70 foot width and 7200 sauare foot area required; 50 foot width and 6150 sauare foot area proposed for one lot). 2. Thet there are exceptional or extraordinary circumstences or conditions applicsble to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 3. That the requested veriance is necessary for the preservation end enjoyment of a substential property right possessed by other property in the same vicinity and zone, and denied to the property in question. 4. That the requested variance will not be materially detrimental to the public welfete or injurious to the prop- erty or improvements in such vicinity and zone in which the property is located. 5. That the requested waivers would permit the properties in question to develop with lot v:idth and lot area comparable to existing lots in this area. V 1-G -1- ~ n 8 NOW, THEREFORE, BE IT RESOLVED thet the Anaheim City Planning Commission does hereby grant subject Petition for Veriance, upon the following conditions whlch ate hereby found to be e necessary prerequisite to fhe pro- posed use of the subject property in order to pteserve the sefety and generel welFere of the Citizens of the City of Anaheim: 1. That th? owner of subject property shall pay to the City of Anaheim the sum of 15~ per front foot along Cherry Way, for tree planting purposes. 2. That a Parcel Map to record the approved division of subject property be su4-.~tted to the City of Anaheim for approval and then be recorded in the office of the Orange Covnty Recorder. 3. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the Building Permit is issued. 4. That the driveways shall be installed along Cherry Way, as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer, prior to final building and zoning inspections. 5. That Condition Nos. 1 and 2, above mentioned, shall be complied with prior to the time that the Building Permit is issued or within a pe_iod of 180 days from date hereof, whichever occurs first, or such further time as the Commission or City Council may grant. 6. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marl:ed Exhibit No. 1.
