A RESOLUTION OF THE CITY PLANNING OJMMISSION OF THE CITY OF ANAHEIM
TeRMINATING ALL PROCEEDINGS ON OJNDITIONAL USE PERMIT N0. 803
WHEREAS, the City Planning Commission on January 31, 1966, in Resolution No. 1926,
Series 1965-66 granted Conditional Use Permit No. 803 subject to conditions; and
WHEREAS~ correEpondence received from the agent for the petitioner revealed that the
property owners would not de9icate a 25-foot corner radius return for street widening
purposes for the northwest corner of Katella Avenue and Harbor 3oulevard; nor would they
repair the damaged and~or hazardous sidewalks along Harbor Boulevard and Katella Avenue,
both requirements being conditions of approval; and
WHEREAS, the agent for the petitioner requested of the Commission on January 8, 1968,
that Condition Nos. 1 and 2 of Resolution No. 1926, Series 1965-66 be deleted, which re-
quest the Planning Commission denied on January 15, 1968, on the basis that it was part
of the normal site development standards of the C-1, General Commercial, Zone in wnich
subject property is located; and
WHEREAS, since the agent for the petitioner has indicated that the prnperty owner
has no intention with complying with Condition Nos. 1 and 2 of the aforementioned
resolution, the conditional use permit would never legally take effect.
NOW, THEREFORE, BE IT RESOLVED that the ~ity Planning Commission of the City of
Anaheim does hereby terminate all proce~edings on Conditional Use Permit No. 803, on
the basis that since the prooerty owner has no intention of complying with conditions
of approval, the conditional use permit would never legally ta;e effect.
