A RESOLUTIQN OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE NO. 1996 gg APPROVED
WHEREAS, the City Plenning Commission of the City of Aneheim did roc~iv~ ~ vaified Petition for Variance from
E. H. BAUMANN, 3254 West Oranc~e Avenue, Anaheim, California 92804, Ovaner of certain real property
situated in the City of Anaheim, County of Orang e, State.of California, described as the Easteriy
215.00 feet of the Westsrly 377.00 f eet of the North half of the Northwest quarter of the Northeas
quarter of the Southwest qua:ter.of Section 14, Township 4 South, Range 11 West, in ~he Rancho Los
Coyotes, as shown on a Map thereof recorded in Book 51, page 11 of Miscellaneous Maps, records of
said County, lyin9 Northerly of the Northerly line of that certain strip of land 75.00 f eet wide
described in deed to the Orange County Flood Control, recorded ~7arch 5, 1959, in Bo.ok 4614, page
499 of Official Records. Said Easterly 215.00 feet being measured along the Northerly line of
sa~d North half.

WHEREAS, the City Planning Commission did hold a public hearing et the City Hail in the City of Aneheim on
July 1~ 1968~ at 2:00 o'clock P.M., notice of said ublic hearin havin been dul
lew end in ecoocdaace with the provisions of the A~iaheim Municipal Code, Chepter 18.68, to hear and c os der evidence or
end egainst said propoced variance and to investigate and meke finding's and recommendations in connection therewith;

WHEREAS, eoid Commission, efter due inspection, investigation, end study made by itsetf and in its behelf,
and efter due considaation of all evIdence and reports offered at said hearing, does find and deteenine the followinQ
Eacts:
1. That the petitioner requests e verience from the AneheIm Municipai Cade as follows, to establish a
one and two-s~ory 23-unit apartment complex on subject property:
SECTION i8.28.050(5-b) - Maximum buildina hei4ht within 150 feet of a sinale-familv
. residential zone. (One-story within 150 feet of R-A p~-
~~ mitted; two-storv within 150 f eet of R-A and R-1 proposed).
SECTrON 1$.28.050(7-a) - Minimum distance between buildin s. (20 feet required; a
minimum of 14 f eet proposed .
SECTION 18.28.050(6-c) - Permitted location of ~ccessorv buildinas. (Accessory
buildings may abut side property lines within the rear 25
, of the building site - permitted; accessory buildings abutti.ng
side property line within t::e front 75 of the building site ~
proposed).
2. That waiver of the one-story height limitation within 150 f eet of the R-1 to the south
is hereby denied on the basis that the petitioner stated he couid redesign the development
eliminating the two-story unit now encroaching into the required 150 f eet; furthermore, approva7
of this waiver would set-an undesirable precedent for similar requests if properties in close
proximity are developed for multi~le family uses.
3. That there are exceptional or extraordinary circumstances or conditions applicable to
the property involved or to the intended use of the property that do not apply generally to the
property or ciass of use in the same vicinity and zone.
4. That the requested variance, as approvezi, is necessary for the preservation and enjoy-
ment of a substantial property right possessed by other property in +.he same vicinity and zone,
and denied to the property in question.
5. That the requested variance, as approved, will not be materially detrimental to the
public welfare or injurious to the property or improvements in such vicinity and zone in which
the property is located.
