PC68-208 \_/ A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 1998 BE DENIED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from WILLIAM F. AND NINA•SIMMONS, 639-Webster Avenue, Anaheim, California 92804, Oyynexs; R. D. MILES~ Bpx 2125,.Anaheim, California 92804, Agent..of certain real property situated in the City.of Anaheim, County of Orange, State of California, described in Exhibit "A" attached hereto and referred to herein as though ~et forth in full ; and 7~' WHEREAS, the City Plenning Commission did hold a public hearing at the City Hall in the City of Anaheim on ~ r July 15~ 1968~ at 2:00 o'clock .P.M., notir.e of said public hearing heving been duly given es required by ;'~ law and in accrotdence with the provisions of the Anaheim Municipal Code, Chapter 18,68, to hear and consider evidence for i end against said proposed variance and to investigate and meke finding's and recommendations in connection therewith; Is ar~d WHEREAS, said Commission, after due inspection, investigation, end study made by itself end in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner requested consideration of the variance petition in its entirety~ { rather than the Commissionts considering only a portion of the Haivers~ since development ~ plans were predicait~c9 on development with the requested waivers. ry 3. That the petitioercan obtain a reasonable density on subject property under the existingi R-3 site development standards~ and granting a waiver for 2-story apartments within ~5 feet ~ of R-1 zoned property would be grantin~ the petitioner a privilege rather than alleviating a a hardship. ~ ~le That there are no exceptional or extraordinary circumstances or conditions applicable i to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone, ' 5.
