PC6A-21 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT NO. 995 BE GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Conditional Use Permit from GABRIEL AND VI~ZGINIA PATIN, 276 6Yilbur A•; enue, Yuba City, California 95991, Owners; WILLIAM D. PRICHARD, 22~34 Ostronic Drive, Woodland Hills, California 91364, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described R~'r as the West 100.00 feet or' the East 350,00 f eet of the South 500.00 feet of the southwest E ~: quarter of the southwest quarter of Section 11, Township 4 South, Range 11 West, in the Rancho ~ ; Los Coyotes, as per map recor.ded in book 51 page 11 of Miscellaneous Maps, in the office of the ' county recorder of said county ; and WHEREAS, the City Planning Commis::ion did hold a public hearing at the City Hall in the City of Anaheim on JanUary 15, 1968Y et 2:00 o'clock P.M., notice of said public hearing having been duly given as required by law and in accrordance with the provisions of the Anaheim Municipal code, Chap;c: 18.64, to hear and consider evidence for and agair.st said proposed rnnditional use and to investigate end make findings and recommeidetions in connection thcrewith; and WHEF2$AS, said Commissian, after due inspection, investigetion, and study mede by itself and in its behalf, and after due consideration of all evidence and reports oEfered at said hearing, does find and detecmine the Eollowing facts: 1. That the proposed use is properly one for which a Conditional Use Fennit is authorized by Cod2: SectiOn 1~s.40.060~f) to wit: establish a 47-unit motel on subject property with waivers of: SECTION 18.40.070(2-a- - Minimum reGUired buildin4 setnack ( A minimum 10 feet re- 5-a) quirad;none proposed along the easterly property line). SECTION 1R,40.070(3-a) - Buildi~ct and structural heiaht limitations (The height of a~y ui c,inq or structure vnt in 5 teet of any single- family residen*izl zone boundary shall not exceed one-half ~ the distance from said building or structure to the zone boundary - the petitioner proposes to develop the motel up cc the easterly property line which is adjacent to a trailer park in the R-A, Zone). 2. That the propo~~-~ use will not adversely effect the adjoining lend u~es end the growth and development of the area in which it is proposed to be located. 3. That the size and shape of the site proposed for the use is adequate to allow the full development of the pmposed use in a manner not detrimental to the particutar area nor to the peace, health, safety, and ganerel welfare of the Citizms of the City of A::oheim. 4. That the granting of :ne Conditional Use Pertnit under lhe corditions imposed, if any, will not be detrimental to the peace, health, saEety, and general welfare oE the Citizens of the City af Maheim. 5. That the petitioner stipulated to limiting all 2-story construction to the west boundarW, and that any construction along the east boundary would be limited to single-story, in order that residents of the mobile home park to the east wil: not be deprived of light and and air. 6. That the petitioner iad indicated that a maximum of 6 units would be equipped with ; kitchen facilities. i ~ .' ~' Cl-G .tY ~ ' 1- -a . ~ 5 e ;_; NOW, THEREFORE, HE IT RESOLVED that the Anaheim City Planning Commission does hercby grent isubject Petltton for Condltional Use Permit, upon the (ollowing conditions which are hereby found to be e necessary prercquisite to the proposed use of the subject property in otder to preserve the safety and generel welfate ofihe Citizens ofthe CIty of Anaheim: 1. That this conditional use permit is granted subject to the conpletion of Reclassi- fication No. 67-6R-46. 2.
