P~8-240 A RESOLUTION OF THECITY.Pi ,: VNING COMMISSION OF THE CITY OF ANAHEIM THAT PETfTION FOR VARIANCE N0. 2001 HE GRANTED WHEREAS, the City Planning Comnission of the City of Anaheim did receive a verified Petition for Variance from EPHRAIM AND ROBERTA E. BFARD, ET AL, 10181 Beach Boulevard, Stanton, California 90680, ~wners:of certain real property situated in the City of Anaheim, County of Orange, State of California, described as Parcel A: The south one-half of the northeast quarter of the northeast ' quarter of S ection 23, Township 4 South, Range il West, in the Rancho Los Coyotes, as per map recorded in Book 51, Page 11 of Miscellaneous Maps in the office of the County Recorder. Except-y ing therefrom the southerly 172 feet.of the wester~y 500 feet thereof. Parcel B: The southeriy ; 172 feet of the westerly 500 f eet of the South one-half of the northeast quarter of the northeast quarter of the northeast quaxter of Section 23, Township 4 5outh, Range 11 West, in the Rancho Los Coyotes, as per map recor;~ed in Book 51, page 11 of Miscellaneous Maps, in the office of the ' County Recorder of said county. , , ; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Aneheim on August 12~ 1968~ at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by law and in eccordance with the provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and co~ sider evidence for and against said proposed variance and to investigate and make findings and recommendations in connec- tion therewith; and WHEREAS, seid Commissinn, after due inspection, investigation, and study made by itself and in its behalf, and after due consi~eration of all evidence and reports offered at seid hearing, does find and detem~ine the following , facts: 1. That the petitioner req,uests a variance from the Anaheim Municipal Code as follows, in order to establish an automobile agency and the non-conforming salvaqe yard as a conforming use: SECTION 18.40.020 - Permitted Uses G 1 Zone (Parcel"A", ~tabiish a new and used autom~obile agency, including all servicing incidental thereto; Parcel "B", permit the continued operation of an existing auto selvage yard-used autos and auto parts, sales and storage. 2. That there are exceptional or extraordinary circumstances or conditions apFlicable to the property invol~ed or to the intended use of the property that do not apply generelly to the property or class of use in the same vicinity and zone. 3. That the requested variartce is necessary.for the preservation and enjoyment of a substantial ptoperty right possessed by other property in the same vicinity and zone, and denied to the ptoperty in question. 4. That the requested varience will not be materially detrimental to the public welfare or injurious to the prop- erty or improvements in such vicinity and zone in which the propedy is loceted. 5. That the existing salvage yard has been a non-conforming use on subject property. 6. That three persons appeared, and a petition signed by 201 residents of the mobile home park to the west of subject property was received, all in opposition.
