A RESOLU'TION OF TfiE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT NO. 1053 gg GRANTED
WHEREAS,' ihe City Planning Commission of the City of Anaheim did receive a verified Petition for Conditionel
Use Pe~mitfrom DAN E. AND BARBARA M. VAIL~ 70171 Highway 111, Cathedral City, Cali£arnia, Owners;
CARL G..LANS, i;s^i Avenue of the Stars, Los Angeles, California 90067, Agent of certain real
property situated in the City of Anaheim, County of Orange, State of California, described as
the ndrtherly 66 feet.of the easterly 330 feet of the east 5 acres of the north 10 acres of the
south 30 acres of the southeast quarter of the northeast quarter of section 8, township 4 south, ~
range 10 west, S. B: B. $ M. ,

WHEREAS, the City Plenning Commission did hold a public hearing at the City Hall in the City of Meheim on
August 12~ 1968~ at 2;00 o'clock P.M., notice of seid public heuring having been duly given as required by
lew end in accordance with the provisions of the Aneheim Municipal rnde, Chepter 18.64, to hear and consider evidence
for and agnir.st seid proposed conditional use and to investigate and make findings and recommendations in cannection
theeewith; and
WHEREAS, said Commission, aEter due inspection, investigation, end study mede by itself and in its behalf, and
after due consideration of ell evidence end reports oEfered at seid heoring, does find end deteenine the following facts:
1. That the proposed use is properly one for which a Conditional Use Peimit is authorized by ~ode:
Section 18.40.060(e), to wit: establirh a drive-through and walk-up restaurant with an
outdoor eating area on subject property.
1~ 2. Thet the proposed use will nat adversely affect the edjoining lend uses end the growth and development of
the aeea in which it is proposed to be located.
3. That the size and shape of the site pmposed for the nse is adequate to allow the ful! development of the
` 'T pmposed use in a manner not detrimental to the perticular area nor to the peace, health, safety, and general welfare of

4. That the grentine of the Conditionel Use Peanit under the condi4ons imposed, if any, will not be detrimental
~ ~ to the peace, health, safety, and generel weifere of the Citizens of the Clty of Meheim.

1..That the..owners..of subject property shall pay to the City of Anaheim the sum of 15¢ per
fr.ont.foot..along:Euclid Street, for tree planting pur oses.
2. That trash storage areas shall be provided inPaccordance with approved plans on file
with the.office of.th.e Dir.ector of Public Works.
3. Th~t any air-conditioning facilities pxoposed shall be properly shielded from view,
~ and the sound shall be buffered from adjacent resider~tial.homes.
~ 4. That.parking areas shall be.lighted with down-lighting a maximum 6-feet in height and
~ ~ shail be directed awa from the
. Y property lines to'protect the residential integrity of the area. i
e~ 5. That Condition No. l, above mentioned, shall be complied with prior to the time that the ~
', Building Pexmit is issued or within a period of 180 days from date hereof, whichever occurs
first, or such further time as the Commission or City Council may grant. ~
a 6. T;~at Condition Nos. 2, 3, and 4, above mentioned, shall be complied with prior to final
building and zoning inspections.
~ 7. That subject property shall be developed substantially in accordance with pl~ns and
_ specifications on file with the Ci~y of Anaheim, marked Exhibit Nos. 1, 2, and 3.
