P~8-244 A RESOLLiTION OF THE CITY PLANNIIV'G COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2004 BE GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from BRUCE AND BLANCHE G. BURT, ET AL, 708 South Pythias Avenue, Anaheim, California 92802, Owner; EDWARD F. FOLEY, 4921 Riverview Drive, Rubidoux, California 92509, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described in Exhibit "A" attached hereto and referred to herein as though set forth in full ; and WHEREAS, the City Planning Commission did hold a public hearing et the City Hell in the City of Anaheim on August 12~ 1968, at 2:00 o'clock P.M., notice of said public heacing having been duly given es required by law end in accordance with the provisions of the Aneheim Municipel Code, Chapter 18.68,to hear and consider evidence for and egainst said proposed verience end to invesfigate and make findings and recommendetions in connec- tion therewith; and WHEREAS, said Commission, after due inspectioq, investigation, and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following E8Ct5: 1. That the petitioner requests a variance from the Aneheim Municipal Code~ as f.ollows~ to permit development of the lots with less than the min~mum lot width and lot area: SECTION 18.24.030~4-a) - Minimum lot area. (7200 sauare feet required; 6250 sauare f eet propos ed) . SEC?ION 18.24.030(4-a) - Minimum lot width. (70 feet required; approximately 54 feet proposed). 2. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of nse in the same vicinity and zone. 3. That the requested varience is necessary for the preservation end enjoyment of a substantiel property right possessed by other property in the same vicinity and zone, and denied to the propecty in question. 4, That the requested variance will not be materially detrimentel to the public welfate or injurious to the piop- erty or improvements in such vicinity and zone in which the property is located. 5. NOW, THEREFORE, BE IT RESOLVED thet the Anaheim City Plenning Commission does hereby grant subject ~ Petition for Veriance, upon the Fo1lowIng conditions which are hereby found to be a necessary prerequisite to Ehe pro- posed use of the subject property in order tc preserve the safety and general welfare of the Citizens of the City of Anaheim: n~ lo That the owners of subject praperty shall pay to the City,of Anaheim the sum of $2.00 ' per front.foot along Pythias.Avenue, for street lighting purposes. ` 2. T.hat the.owners of subject.property shall pay to the City of Anaheim the sum of 15¢ per front•foot along Pythias Avenue, for tree planting purposes. 3. That the sidewalks and curbs shall be repaired along Pythias Avenue, as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. ~,_ ~- - 4. That the owners~of svbject property shall pay to the City of Anaheim the sum of $25.00 ^ per dweiling unit, to be used for park.and recreation purposes, said amount to be paid at the ~ ~' time,the Building Permit is issued. ~ ~.~ 5. That Condition Nos. 1 and 2, above mentioned, shall be complied with prior to the time that the Building Permit is issued or within a period of 180 days from date hereof, whichever d ~ occurs first, or such further time as the Commission or City Council may grant. rt , 6.
