BE GRANTED ~ ~ WHEREAS, the City Plenning Commission of the City of Meheim did ceceive e verified Petition for Variance f'` from WILLIAM C. AND PHYLLIS A. BURCH, 2107 West Judith Lane, Anaheim, California 92804, Owners ~ f< of certain real property situated in the City of Anaheim, County of Orange, State of California, ~ described as Lot No. 56 of Tract No. 1931 ~:: ~ ~ ; and WHEREAS, the City Planning Commission did hold e public hearing at the City Hall in the City of Anaheim on Sept~nber 11~ 1968~ at 2:00 o'clock P.M., notice of said public hearing having been duly given es requited by law and in accorde~ce with the provisions of the Aneheim Municipel Code, Chapter 18.68,to hear and consider evidence for and xgainst said proposed varience end to investigate and meke findings end recommendations in connec- tion therewith; end WHEREAS, said Commissinn, efter due inspection, investigation, end study made by itself end in its behalf, and aftet due consideretion of all evidence and teports offemd at said hearing, does find and deteimine the foilowing ~'acts: ' i. Thet the petitioner requests a variance from the Anaheim Municipal Code as follows, to permit the keeping of exotic, non-poisonous reptiles on subject property: SECTION 18.24.010 - Permitted use R-1 Zone. (Non-domestic animals prohibited; a maximum of four non-poisonous reptiles proposed). 2. That thece are exceptionel or extreordinary circumstences or conditions appliceble to the property involved or to the intended use of the property that do not apply generelly to the property or cless of use in the same vicinity and zone. 3: That the :equested verience is necessery for the preservation and enjoyment of a substential property right possessed by other property in the seme vicinity and zone, end denied to the property in question. 4. That the requested variance will not be meterially detrimental to the public welfate or injurious to the p:op- erty or improvements in such vicinity end zone in which the property is loceted. 5. That 13 persons appeared in favor, and a petition signed by 105 persons was received in favor, and that 7 persons appeared in opposition to subject petition. Petition for V~riance, upon the following cond9tions which are hereby found to be a necessary prerequisite to the pro- posed use of the subject property in order to preserve the sefety and general welfare of the Citizens of the City of . ~ Anaheim. 1. That a.maximum of four (4) non-poisonous reptiles not over 10 feet in length may be s, , J retained on sub,ject..property. •.I 2. That in order to.maintain a health factor, no related feeding process animals or ~ ;, any means• by whi.ch the reptiles will be fed, shall be maintained in a live state on,$ubject property. 3. That all safety precautions such as locked cages, locked rooms, and locked garage, as.stipulated by the.peti~f~ners, shall be adhered to at,all times for the protection of the .children in the neigh{:l~orhood. ~~: ~.
