P~68-272 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2014 BE GRANTED WHEREAS, the City Plenning Commission of the City of Anaheim did receive e verified Petition for Varience from R. P. Lemmon, 211 Topo Street, Anaheim, California 92804, OWner of~certain real property si~•.~ated in the City of Anaheim, County of Orange, State of California, described as Lot No. 102 of Tract No. 1940 ; and WHEREAS, the City Plenning Commission did hold e public hearing at the City Hell in the City of Anaheim on September 11~ 1968~ at 2:00 o'clock P.M., notice of seid public hearing having been duly given as required by law end in accordance wiL~ the provisions of the Aneheim Municipal Code, Chepter 18.68,to hearand consider evidence for and ageinst said proposed variance end to investigete and make fIndings and recommendations in connec- tion therewith; and WHEREAS, seid Commission, after due inspection, investigation, and stt~dy made by itself and in its behelf, and after due consideration of all evidence and reports offered at seid hearing, does find and detem~ine the following facts: 1. Thet the petitioner rec~uests e variance from the Anaheim Municipel Code as follows, to pPSmit .in- creasing .the height of an existing masonry wall to six feet, and the construction of a swimming paoi in the front setback. SECTION 18.24,030(1-a) - Mir,imum re uired front setback area. (25 feet required; 13.5 feet proposed . • 2. That there are exceptional or extraordinary citcumstences or conditions epplicable to the property involved or to the intended use of the property that dc iot apply generally to the pmperty or cless of use in the same vicinity and zone. 3. That the cequested verience is necessery for the preservation and enjoyment of e substantial property right possessed by other propetty in the seme vicinity and zone, end denied to the property in question. 4. ThaS t,he requested veriance will not be materially detrimental to the public welfare or injnrious to the prop- erty or improvements in such vicinity and zone in which the propedy is located. 5. That other similar variances have been granted in the residential tract of which subject property is a part, and that approval of this variance will not create any problems for automobile traffic at the intersection of Topo Street and Mall Avenue.
