P~'8"2~5 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2012 gE APPROVED I N PART WHEREAS, the City Plenning Commission of the CIty of Anaheim did receive a verified Petition for Varience from EUGENIA WESTON DARIAN, et al, 415 Flores, Los Angeles, CaliFornia 90064, OW~er; RICHARD S. LAUB JR. AND FRANK M. HARLEM JR., 2140 North Me'in Street, Santa Ana, California 92706, Agents of certain real property situated in the City of Anaheim, County of Orange, State of California, described as Lot Nos. 4 and 5 of Tract No. 2637. . ; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on September 11~ 1968~ at 2:00 o clock P.M., notice of said public hearing heving been duly given as required by law end in accordence wIth the provisions of the Aneheim Municipal Code, Chepter 18.68, to hear and consider evidence for and ageinst said proposed veriance and to investigate end meke finding's end recommendetions in connection therewith; and WHEREAS, said Commission, efter due inspection, investigetion, end study mede by itself and in its behelf, end after due consideration of ali evidence end reports offeeed 3t said heating, does find and detecmine the following facts: 1. Thet the petitioner requests e veriance from the qneheim Municipel Code as follows~ to permit the development of subject property with 3 four-plex apartment units: SECTION 18.28 050(5-b) - Maximum .;uildina heicaht within 150 feet of sinale- familv~zo_~e; (~One-sto~r permitted; two-storv - Parcels ~ and B proposed). SECTION 18,2g,050(6-a-4) - Minimum buildinq setback from a 7n~ required; 13 f eet proposed), al street. (15 f eet 2, That there are exceptional or extraordinary circumstances or conditions applicable to the proper~y involved or to the intended use of the pr.operty that do not apply generally to the property or class of use in the same vicinity and zone. 3o That the requested variance is necessary for the preservation and enjoyment of a substantial.prop~ty right possessed by other property in the same vicinity and zone and denied to the..property in question. 4. That the requested variance will not be materially detrimental to the public welfare or in3urious to the property or improvements in such vicinity and zone in which the property is located. 5. That the request for waiver of the one-story heiqht limitation within 78 f eet of the singl rfamily residential zone to the west is denied on the basis that granting the waiver would be granting a pr.ivilege not granted to other properties recently developed for mi~ltiple family purposes within 150 f eet of single family homes. 6. That one person appeared, and one letter was received in opposition to subject p etition. That this variance is granted subject to the completion of Reclassification No. 68-69-24. '" 2. That trash storage areas shall be provided in accordance with approved plans on f ile.with.the.office.of the Director of Public Works. 3._That.any.air-conditioning f.acilities proposed shall be properly shielded from view,. and the sound shall be buffered from adjacent residential homes. 4.
