A RESOLUTION OF THE CITY PLANNWG COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 2021 BE DENIED
WHEREAS, the City Plenning Commisyion of the City of Anahetm did receive a verified Petition for Veriance from
J. A. SBYMOUR, 3347 West Ball Road, G. P. BROOKS, 3341 West Ball Road, A. D~ HETH, 3351 West
Ball Road, Anaheim, California 92804, Owners of certain real property situated in the City of
Anaheim, County of Orange, State of California, described as Lot No. 1 of Tract No. 2839

.~ WHEREAS, the City Planning Commission did hold e public hearing at the City Hall in the City of Anaheim an
~ October 7. 1968~ at 2:00 o'clock P,M., notice of aaid publIc headng having been duly g~vm es requimd by
law end in eccocdence wlth the provisions of the Anoheim Municipel Code, Chepter 18.68, to hear and consider evidence for
~ and ageinst seid proposed veciance and to investigate and meke findings end recommendotions in connection therewith;
and
WHEREAS, seid Commissian, efter due inspection, investigation, end study made by itself and in its behelf,
and efter due consideration of all evidence end reports offered at snid hearing, does find and determine the following
_ facts:
1. That the petitioner requests a variance from the Aneheim Municipel Code as follows, to peT.mit utilization'
of Lot No. i for a chiropractic office. 3
SECTION 18e40.070(4-a-1-c) - Off-street parking. ~Lot No. 1 only - 10 oa*kina soaces
required; 8 parkin4 spaces proposed).
2, That there are no exceptional or extraordinary circumstances or conditions applicable
to the property involved or to the intended use of the pro~erty that do not apply generally
to the property or class of use in the same vicinity and zone.
3, That the requested variance is not necessary for the preservation and enjoyment of a
substantial property righ± possessed by other property in the same vicinity and zone, and
denied•to the pr.operty in question.
4. That the requested variance will be materially detrimental to the pub: .; welfare or
injurious to the property or improvements in such vicinity and zone in which t~ property is
located.
g, That one person appeared representing several persons present in the Council Chamber,
and a petition signed by 34 persons was received, all in opposition.

NOW, THEREFORE, BE IT RESOLVED that the Aneheim City Planning Commission does hereby deny subject
Petition for Vatiance on the besis of the eforementioned findings.
