PC 68-306~~;: ~ .~ _- ;r ~ PC68-306 ' RESOLUTION ~> __ ~ A RESOLUT[ON OF THE CITY PLANNING COMMISSION OF i'HE CITY ~F ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT 1050 BE DENIED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Con- ditionel Use Permit from FRANK HORNY, 353 South La Brea Avenue, Los Angeles, California 90036, Owner; HAP,RY KNISELY, Suite B, 1741 South Euclid Avenue, Anaheim, California 92802, Agent of certain real property situated in the City of Maheim, County of Orange, State o£ California, describetl in Exhibit "A" attached hereto and ref erred to herein as though set forth in full ; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on ~Ctober 7, 1968, at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by law and in accordence with the provisions of the Anaheim Municipal code, Chapter 18.64, to hear and consider evidence for end against said proposed conditional use and to investigate and meke findings and recommendations in connection therewith; and WHEREAS, said Commission, efter due inspection, investigation, and study made by itself and in its be- half, and after due consider~Yion of nll evidence and reports offered at seid heering, does find and determine the following facts: 1. That although the property is zoned for E-3, Multiple Family Residential, land use, to permit development of the property at the density proposed wouid create an undue hardship on public facilities and on Nortn Street which has not been designed to handle the proposed increase in traffic. 3. That the proposed use will adversely affect the single family homes fronting on North Street and the adjoining land uses and the growth and d evelopment of the area in which it is proposed to be located. 4. That the size and shape of the site proposed for the use is adequate to allow the full development of the property within the confines of the density requirements and site development standards of the R-3 Zone, in a manner which would not be detrimental to the particular'area nor to the peace, health, saf ety, and generai welfare of the Citizens of the City of Anaheim. 5. I'hat the agent for the petitioner indicated that they would xedesignthe develop- ment to comply with all R-3 Zone requirements EXCEPT the one-story height limitation within 150 feet of R-1 or R-0 Zoned property, the two-story height limitation, and the density; however, historically the City has not granted waiver of the one-story height limitation based on the fact they were desirous of preserving the residential integrity and the privacy of a low-density residential area, and if the density requirement were changed, it would upset the balance between the public facilities and the people living in this area. 6. That waiver of the one-story limitation ar;jacent to single family zoning would set an undesirable precedent for the entire City, and the petition:er had not proven that development of the property under the R-3 Code requiremants uvould create a hardship. 7. That the proposed increase in traffic volume would exceed the capacity of the str eet by more than 20% and would create a hazard for the children attending the school and youngsters utilizing the YMCA facilities presentiy under constructiono 8, That 7 p~sons appeared to represent 25 persons at the first hearing, 30 persons at the second hearing, and 40 persons at the last hearing, all in opposition; and that a petition signed by 15~ persons was received in opposition, as well as 10 persons appeared in favor of subject petition. IdOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby deny subject Petition for Conditional Use Permit on the basis of the aforementioned findings: THE ~REGOING RESOLUTION Zs signed and approved by me this 17th day of October, 1968.
