P~68-308 ~ A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1064 gE GRANTED WHEREAS, the City Plenning Commission of the City of Anaheim did receive a verified Petition for Conditional , Use Permit from ARIA A. Yt7DER, 1118 Estelle Lane, NewpoTt Beach, California 92660, Owner; CASPER BREWER, 1750 Ladera Vista Drive, Fullerton, California, 92631, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as Lot 4 in - Block B of Tract No. 13, as shown on a Map recorded in Book 9 ..> records of Orange County. Excepting therefrom the Southerly 378a44 feetf AlsoeexceptingMthere- from the Northerly 195.00 feet, measured from the centerline of the street adjoining said Lot 4 on the North as said street is shown on said Map ~ ; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on October 21, 1968~ at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by law end in accordance with the provisions of the Anaheim Municipal code, Chapter 18.64, to hear and consider evidence for and agair.st said proposed conditional use and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a Conditional Use Permit is authorized by Code: Section 18,40,060(e) to wit: establish a semi-enclosed restaurant with outdoor eating area. 2. Tha! the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. That the size and shape of the site proposed for the use is adcquate to allow the full development of the proposed use in a manner not detrimental to the particular e~ea nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 4. That the grenting of the Conditional Use Peimit under the canditions imQosed, if any, will not be detrimental to the peace, health, safety, and general welfare of the Citizens of the City of Maheim. M_ ;~ ..~.,_ i a : ~d i ,~ 1 . ~ >,,,.~ l . : ~:.a.~- _. .._ __._. _~_ , ~ ~ NOW, THEREFOe~E, BE IT RESOLVED thet the Anaheim City Plenning Commission does hereby grant subject PetitIon for Conditionel Use Permit, upan the following condttions which are hereby found to be a necessary prerequisite to the proposed uae of the subject property in order to preserve the safety end general welfare of the Citizens of the ~ City of Anaheim: i 1, That the owner of subject property shall pay to the City of Anaheim the sum of 15~ per front foot along Brookhurst Street, for tree planting purposes. 2. That trash storage areas shall be provided in accordance with approved plans on file with tl~e office of the Director of Public Works. 3. That a 6-foot masonry wall shall be constructed along the east property line. ~ 4. That any air-conditioning facilities proposed shall be properly shielded from view, and the sound shall be buffe~ed from adjacent residential homes. ' g. That parking areas shall be lighted with down-lighting a maximum 6 feet in height and I shall be directed away from the property lines to protect the residential integrity of the ar ea. ~ 6. That Condition No. 1, above mentioned, shall be complied with within a period of 180 days from the date heseof, or such further time as the City Council may grant. 7.
