P~68-309 p RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1068 gE GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Conditional Use Permitfrom GRAND MAI3NIER COMPANY, 415 West 4th Street, Tustin, California 92680, Owner of certain real property situated in the City of Anaheim, County of Orange, State of California, ; described as That portion of Lot 13 of Helen and Lynch's Subdivision, as shown on a Map recorded ~~`^ in Boo}: 442, page 158 of Deeds, Records of Los Angeles County. Pascel 1 as shown on Map filed ,. ,,~ in Book 9, page 5, of Parcel Maps, records of said County. 1'. ; and WHEREAS, the City Plenning Commission did hold a public hearing at the City Hall in the City of Anaheim on ~Ctober 21~ 1968, et 2:00 o'clock P.M., notice of said public hearing having been duly given as required by law end in accordance with the provisions of the Anaheim Municipal code, Chaptet 18.64, to hear ar.d consider evidence for and agair.st said propased conditional use and to investigate and make findings and recommendations in connection therewith; and WHEREAS, seid Commission, after due inspection, investigation, and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and deteenine the following facts: 1. ~That the Ptoposed use is properly one for which a Conditional Use Permit is euthorized by Code Section 18.40.060(e) to wit: establish a walk-up and drive-through restaurant on subject property. 2, ihat the proposed use will not adversely affect the edjoining land uses end the growth and development of ~ the area in which it is proposed to be located. 3, Thet the size and shape of the site proposed for the use is edequate to allow the full development of the proposed use in a manner not detrimental to the particular etea nor to the peece, health, safety, and general welfere of the Citizens of the Ciry of Aneheim. 4. That the grenting of the Conditional Use Pertnit under the conditions imposed, if any, wili not be detrimental to the peace, health, sefety, and general welfare ot the Citlzena of the Clty o( Anaheim. NOW, THEREFORE, BE IT RESOLVED thet the Aneheim City Plenning Commission does hereby grent subject PeEition for Conditionel Use Permit, upon the followIng conditions which ore hereby Eound to be a necessery prerequisite to the proposed use of the subject property in order to preserve the safety and general welfere of the Citizens of the CIty of Anahelm: 1. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Workso 2. That any air-conditioning facilities proposed shall be properly'shielded from view. 3. That parking areas shall be liqhted with down-lighting a maximum 6-feet in height and shall be directed away from the property lines to protect the residential integrity of the area. 4. That Condition Nos. 1, 2, and 3, above mentioned, shall be complied with prior to finai building and zoning inspections. 5. That subject property shall be developed substantially in accordance with plans and specifications on file with the City.of Anaheim, marked Exhibit Nos< 1, 2, and 3; provided, however, that the vehicular circulation pattern is revised to minimize the stacking up of cars on Euclid Street,said revised pattern to be approved by the Development Services De- partment.
