SIMMONS, % MIL~S AND ASSOCIATES, Box 2125, Anaheim, California, Owne~s; R~ D. MILES, 800 South Brookhurst, Anaheim, California 92804, Agent of certain real property situated in the ~ity of Anaheim, County of Orange, State of California, described as Lot Nos. 5, 6 and the north half of Lot No. 7 of tract No. 796 . 't ; and ' WHEREAS, the City Planning Commission did hold a publIc hearing et the City Hall in the City of Aneheim on ~ '~ ; November 4, 1968, at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by ; iF law end in acoordence with the provisions of the Aneheim Municipel Code, Chepter 18.68, to hear and consider evidence for and ageinst said proposed variance and to investigate end meke flnding's end recommendetions in connection therewith; and WHEREAS, seid Commission, efter due inspection, invesGga4on, and atudy made by itself and in its behelf, ~~ ~ and after due consideration of all evidence and reports offered at seid heoring, does find and determine the following ~ fects: 9 s 1. That waiver of adequate vehicular access for City service vehicles is hereby denied ~ !;a$ on the basis that adequate fire protection cannot be given to residents of the extreme westerly ` ' units thereby being materially detrimental to the public welfare and injurious to the property `:;I ~ or improvements in the general area surrounding subject property. 3. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generaliy to the property or class of use in the same vicinity and zone. That the requested variance is necessary for the preservation and enjoyment of a ? substantial property right possessed by other property in the same vicinity and zone and denied to the property in queation. ~ '`3 5. That the requested variance, as approved, will ~ot be materialiy detrimental to the ' public welfare or injurious to the property or improvements in such vicinity and zone in which • the property is located. ' . . ~ 0 '~ _ I ~ , ~ I ~..~ ,.. ~;~~._ . ; _ _. _.._ I_ ~~ . ~' ~_~ n part IVOW, Tc1EREFORE, BE IT RESOLVED thet the Aneheim City Planning Commission does hereby grant subject Petition for Varience, upon the following conditions which are hereby found to be a necessary prerequisite to the pro- posed use of the subject property in order to preserve the safety and generai welfare of the Citizens of the City of Anaheim. 1. That this variance is granted subject to the completion of Reclassification No. 63-64-62(6). 2. That trash storage areas shall be provided in accordance with approved plans on file with the office of.the Director of Pul~iic Works. 3. That fire hydrants•shall be installed as required and determined to be necessary by the Chief of the Fire Department. 4. That a 6-foot masonry.wall shall be constructed along the west pzoperty line. 5. That any air-conditioning facilities proposed shall be properly shielded :`rom view, and the sound shall be buffered from adjacent residential homes. 6. That Condition Nos. 2, 3, 4, and 5, above mentioned, shall be complied with prior to final building and zoning inspections. 7. That subject property shall be developed substantially fn accordance with plans and specifications on file with the City of Anaheim, marked Exhibit Nos. 1 and 2, Revision No. 2; provided, however, that a two-lane 24-foot wide emergency drive for City service vehicles and commercial vehicles is developed along the the north property line leading to the proposed cul-de-sac, and that said emergency drive shall r~nain unblocked at all times.
